NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by David A. Horton, Lesly Horton to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, dated May 3, 2007 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 42952, Page 249, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Bank, FSB, its successors and assigns to The Bank of New York Mellon f/k/a The Bank of New York as indenture trustee for CWHEQ Revolving Home Equity Loan Trust, Series 2007-D, recorded on November 16, 2022, in Book No. 68496, at Page 26
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 10:00 AM on February 13, 2026, on the mortgaged premises located at 16 West Street, Winchendon, Worcester County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
A certain parcel of land with buildings thereon, situated in the Southwesterly side of West Street, in Winchendon, Worcester County, Massachusetts, bounded and described as follows:
Beginning at a Southeasterly corner thereof, at a point in the Southwesterly line of West Street at a corner of land of George F. and George J. Shannon;
Thence Westerly by said Shannon land 124.58 feet;
Thence Southerly, still by said Shannon Land, land of Percy D. & M. Thibodeau, and land of Joseph P. Jr. and Lynne E. Connors, 212.52 feet to land of George & Ida M. Kliskey;
Thence Westerly by said Kliskey land 99 feet to a corner of land of John & G. Goan;
Thence Norther, by a stone wall by said Goan land, land of Stanley C. & J. Begor and land of Emest J. & J.M. Dionne about 225.40 feet to a corner of land formerly of the Estate of Dora E. Weeks and now being land of Brian & Tina Jean, and being further shown as Lot "A-1" on a plan hereinafter referred to, (the following three courses are from said plan hereinafter referred to);
Thence N 34 deg 48' 39" E, by said Lot "A-1" 70.59 feet, to a corner at Lot "B-1" on said plan;
Thence N 78 deg 00' 00" E, 51.28 feet;
Thence N 70 deg 45' 00" W 67.86 feet to a point in the Southwesterly line of West Street, the preceding two courses being by said Lot "B-1" and the preceding three courses being by said Jean land;
Thence S 35 deg 22' 48" E, by said street line 105.00 feet to corner of land of the first mentioned Shannon and the point of beginning.
The portion of the description above the abuts land of Brian & Tina Jean, which is the result of the above recited deed to Hayes from Weeks (Book 11560, Page 69), and a parcel that had been deeded to the Estate of Dora E. Weeks from Luther H. Jr. and Phyllis J. Hayes, (recorded in Book 11560, Page 68), are shown as Lots "B-1" and "A-1" on a plan entitled: "Plan of Land Exchanges" prepared for Luther H. Jr. & Phyllis J. Hayes, Winchendon, MA, August 9, 1988 Szoc Surveyors, 32 Pleasant Street, Gardner, MA, recorded in
Worcester District Registry of deeds in Plan Book 605, Plan 6. Excepting said Lot "A-1" as shown on Plan Book 605, Plan 6.
Subject to a first mortgage dated June 20, 2003 and recorded in the Worcester County (Worcester District) Registry of Deeds at Book 30546, Page 379 in the original principal amount of $159,000.00.
For mortgagor's(s') title see deed recorded with Worcester County (Worcester District) Registry of Deeds in Book 26903, Page 363.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
