NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Worcester.
REQUEST FOR RELEASE OF FUNDS
On or about February 3, 2026 the City of Worcester will submit a request to the US Department of Housing and Urban Development (HUD) ) for the release of funds related to the Consolidated Appropriations Act, 2024, (P.L. 118-42) and the Explanatory Statement for Division L of that Act, which was printed in the Senate section of the Congressional Record on March 5, 2024 (Explanatory Statement) as deemed to be amended by the Further Consolidated Appropriations Act, 2024 (Public Laws 118-47), Congress made available “grants for the Economic Development Initiative for the purposes of Community Project Funding/Congressionally Directed Spending.” These Community Project Funding (CPF) awards are administered by the Department of Housing and Urban Development (HUD) and will be used to fund part of the proposed development known as the 38 Hermon Street Project.
Centro Las Americas/New Americans Community Development Corporation will acquire the 38 Hermon Street lot, demolish the commercial garage warehouse and storage structures onsite, and construct a 6-story building with basement garage consisting of 60-units of affordable housing development. The 60-units of housing will consist of 9 studio units, 22 one-bedroom units, 22 two-bedroom units, and 7 three-bedroom units. All these units will be restricted to tenants at 80% of AMI (Area Median Income). In addition, there will be community space and a community garden on the roof. The project will include utilizing all energy-efficiency appliances, utilizing energy-efficient building materials, the use of green spaces, a community area, bike racks, and the possible location of EV Charging Stations, if appropriate. It is estimated that there will be a commitment of $2,654,000.00 of Community Project Funding (CPF) (B-24-CP-MA-0989) for this project.
FINDING OF NO SIGNIFICANT IMPACT
The City of Worcester has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Executive Office of Economic Development, Division of Housing in City Hall, 455 Main St.4th Floor Worcester, MA 01608 and may be examined or copied weekdays 9 A.M to 5 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Executive Office of Economic Development, Division of Housing. All comments received by February 2, 2026 will be considered by the City of Worcester prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Worcester certifies to the US Department of Housing and Urban Development (HUD) that Eric D. Batista in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows 38 Hermon Street to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Worcester’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Worcester; (b) the City of Worcester has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be sent to CPDRROFBOS@hud.gov or addressed to Thomas P. O'Neill, Jr. Federal Building, Attn: Christine Baumann, 10 Causeway Street, 3rd Floor. Boston, MA 02222-1092. Potential objectors should contact HUD to verify the actual last day of the objection period.
