NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Pueblo.
REQUEST FOR RELEASE OF FUNDS
On or about February 12, 2026 the City of Pueblo will submit a request to HUD for the release of HOME-ARP funds under Section 3205 of the American Rescue Plan Act of 2021 (P.L. 117-2) (“ARP”) to undertake a project known as “Non-Congregate Shelter Expansion for The Pueblo Shelter” for the purpose of expanding an existing public facility, The Pueblo Shelter, with several infrastructure features and amenities so it may better serve unhoused community members in Pueblo, Colorado. The proposed project would include activities like adding non-congregate shelter units onto the campus, adding security fencing around the perimeter of the project site for safety and security of those utilizing the space, adding/improving ADA infrastructure features within the campus, adding campus amenities as needed, and completing necessary activities to improve programming for those utilizing The Pueblo Shelter. The specific project activities would also include engineering design, materials acquisition, site work, infrastructure development, ADA accessibility improvements, and construction of non-congregate shelter units and fencing. The proposed project would take place on Parcels #05-362-05-035, #05-362-05-008, and #05-361-21-005 located at the existing campus of The Pueblo Shelter (728 W 4th Street, Pueblo Colorado, 81003). The project, if completed would help The Pueblo Shelter serve unhoused individuals in Pueblo by providing a new non-congregate option, safety features, amenities, and essentials services for those need it. The Total Project Funds will be $950,000. The total amount of HUD funds to being used will be $950,000. The total amount of Other Funds being used will be $0.00.
FINDING OF NO SIGNIFICANT IMPACT
The City of Pueblo has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Pueblo Housing and Citizen Services at 2631 E. 4th Street, Pueblo Colorado 81001 and may be examined or copied weekdays 8:00 A.M to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Pueblo Housing and Citizen Services Department located at 2631 E. 4th Street, Pueblo Colorado 81001 or at housing@pueblo.us. All comments received by February 11, 2026, will be considered by the City of Pueblo prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Pueblo certifies to HUD that Heather Graham in her capacity as City of Pueblo Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Pueblo to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City of Pueblo’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Pueblo; (b) the City of Pueblo has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at CPDRROFDEN@hud.gov. Potential objectors should contact CPDRROFDEN@hud.gov to verify the actual last day of the objection period.
