EXECUTION AND ORDER OF SALE

IN AND FOR THE COUNTY
OF MARICOPA
SCOTTSDALE COLONY HOMEOWNERS ASSOCIATION, an Arizona non-profit corporation, Plaintiff(s),
vs.
MARYANNE D. BERNARD AND DOE SPOUSE BERNARD; THE UNKNOWN HEIRS AND DEVISEES OF THE ABOVE-NAMED DEFENDANTS, IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 29th day of January, 2026, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 3rd day of September, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, above-named, as follows:
Amounts awarded in judgment, accruing interest at rate stated in judgment -- $18,556.68; Pre-judgment interest -- $174.33; Interest accrued on judgment through November 7, 2025 -- $154.81; Supplemental attorney fees and costs pending Court approval -- $1,536.83; Less credits or payments applied --($10,000.00); Total judgment balance as of November 7, 2025 -- $10,422.65.
Interest will continue to accrue at the rate of $1.40 per diem from November 8, 2025. Additional assessments will accrue January 1, 2026 in an amount not less than $3,792.00, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 291, of THE COLONY AT SCOTTSDALE, according to the plat of record in the office of the County Recorder of Maricopa County, Arizona, recorded in Book 171 of Maps, Page 17, and Certificate of Correction recorded in Document No. 92-0007327, of Official Records.
AKA: 6350 North 78th Street #291, Scottsdale, Arizona 85250.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 26th day of February, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
