By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Barbara L. Worn and Michael M. Worn to Mortgage Electronic Registration Systems, Inc., as nominee for IndyMac Bank, F.S.B., its successors and assigns, dated December 8, 2006 and recorded with the Worcester County (Worcester District) Registry of Deeds at Book 40330, Page 98, subsequently assigned to Deutsche Bank National Trust Company, as Trustee of the Home Equity Mortgage Loan Asset-Backed Trust Series INABS 2006-E, Home Equity Mortgage Loan Asset-Backed Certificates, Series INABS 2006-E under the Pooling and Servicing agreement dated Dec 1, 2006 by Mortgage Electronic Registration Systems, Inc. (MERS), solely as nominee for IndyMac Bank, F.S.B., A Federally Chartered Savings Bank by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 49006, Page 62 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on February 26, 2026 at 579 Alger Street fka 259 Alger Street, Winchendon, MA, all and singular the premises described in said Mortgage, to wit:
The land with the buildings thereon known and numbered as 259 Alger Street, Winchendon, Worcester County, Commonwealth of Massachusetts, bounded and described as follows:
COMMENCING at a point in the Westerly line of Alger Street, at the Southeast corner of Lot 6, as shown on a plan entitled, " Boundary Survey for Land/Vest Properties, 1973 Limited Partnership, Winchendon, Mass., Scale: 1 inch = 100 ft. -- June 23, 1978, Michael S. Szoc, R. L. Surveyor, 32 Pleasant Street, Gardner, Mass." which plan is recorded with Worcester District Registry of Deeds, Plan Book 454, Plan 121; thence
In a Southerly direction 280 feet, more or less, following the Westerly line of said Alger Street to a point which marks the Northeast corner of Lot 4, as shown on said plan; thence
Turning and running North 76° 45' West, 1,365 feet, more or less, in the Northerly line of said Lot 4 to an iron pin which marks its Northwest corner; thence
Turning and running North 26° 30' East, 255 feet, more or less, in the Easterly line of land now or formerly of Amenta, as shown on said plan, to an iron pin set at the Southwest corner of said Lot 6; thence
Turning and running South 76° 45' East, 1324 feet, more of less , in the Southerly line of said Lot 6 to the place and point of beginning.
Being Lot 5, as shown on said plan, and containing 8.2 acres, more or less.
Being the same premises conveyed to the herein named mortgagor (s) by deed recorded with Worcester District Registry of Deeds in Book 35029, Page 228.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
