MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Richard P. Kivel and Lisa L. Kivel to Mortgage Electronic Registration Systems, Inc., as nominee for Santander Bank, N.A., its successors and assigns, dated June 30, 2016 and recorded with the Plymouth County Registry of Deeds at Book 47128, Page 276, subsequently assigned to Santander Bank, N.A., its successors and assigns by Mortgage Electronic Registration Systems, Inc. (MERS), as nominee for Santander Bank, N.A., its successors and assigns by assignment recorded in said Plymouth County Registry of Deeds at Book 47824, Page 94 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on March 4, 2026 at 166 Norwell Avenue, Norwell, MA, all and singular the premises described in said Mortgage, to wit:
A certain parcel of land in said Norwell, Plymouth County, Commonwealth of Massachusetts bounded and described as follows:
NORTHEASTERLY by Norwell Avenue, three hundred sixty four and 31/100 (364.31) feet;
EASTERLY by a curved line of radius forty (40.00) feet, by other land now or formerly of Gould, sixtytwo and 83/100 (62.83) feet;
SOUTHEASTERLY by land now or formerly of Gould, two hundred forty (240) feet;
SOUTHWESTERLY by land now or formerly of Gould, three hundred fifty-two and 12/100 (352.13) feet;
NORTHWESTERLY by Lot 5, as shown on a "Plan of Land on Norwell Avenue, Norwell, MA drafted for Robert S. Cushing, February 28, 1965, George F. Reekie, Registered Land Surveyor, Norwell County Registry of Deeds in Book 3005, Page 404, S. 34 45' 35" W two hundred ninety (290.00) feet.
Containing 108,000 square feet of land together with the frame buildings thereon, being a portion of the land shown on a "Plan of Land, Norwell, Mass., to be conveyed to Robert S. Cushing, et al, March 21, 1956, Joseph H. Gould, Eng." and recorded with Plymouth County Registry of Deeds in Book 2488, Page 3, on March 28, 1956.
Subject to and with the benefit of all rights, restrictions and easements of record, insofar as the same may now be in force and applicable.
Subject to a taking by the Town of Norwell recorded with said deeds in Book 3849, Page 332.
Subject to a Grant to the Town of Norwell for Easement recorded with said deeds in Book 5090, Page 287. For mortgagor's title see deed recorded immediately prior hereto.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIFTEEN THOUSAND DOLLARS AND 00 CENTS ($15,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
