MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by James E. Murnaghan to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Wachovia Mortgage, FSB, its successors and assigns, dated May 14, 2008 and recorded in Plymouth County Registry of Deeds in Book 35977, Page 305 (the “Mortgage”) of which mortgage Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Trustee of CSMC 2021-RPL8 Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Wachovia Mortgage, FSB, its successors and assigns to Wells Fargo Bank, NA dated July 8, 2011 and recorded at said Registry of Deeds in Book 40115, Page 251, and Assignment from Wells Fargo Bank, NA to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee of CSMC 2021-RPL8 Trust dated November 23, 2021 and recorded at said Registry of Deeds in Book 56061, Page 343, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 12 St. Charles Avenue, Plymouth, MA 02360 will be sold at a Public Auction at 3:00 PM on March 4, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land with the buildings thereon situated on the Northeasterly side of Saint Charles Avenue, Plymouth, Plymouth County, Massachusetts, more particularly bounded and described as follows:
SOUTHWESTERLY by Saint Charles Avenue, as shown on the hereinafter mentioned plan, 55.00 feet;
NORTHWESTERLY by land now or formerly of Henry L. & Joan Cappella, as shown on said plan, 38.35 feet;
NORTHEASTERLY by Lot 44B, as shown on said plan, 54.69 feet; and
SOUTHEASTERLY by land now or formerly of Margaret T. Ladd, as shown on said plan, 44.65 feet.
Containing, 2,.270 square feet and being shown as Lot 44A on plan entitled, "Plan of Land in Plymouth, Mass. Showing Lot 44A to be conveyed to William Cronin 1"=15' June 6, 1979, Hood & Stefani Surveyors, Rock Hill Road, Plymouth, Mass." which plan is recorded in the Plymouth County Registry of Deeds.
SUBJECT to a ten (10) foot wide right of way for the benefit of Lot 44B as shown on said plan.
SUBJECT to all easements and restrictions of record as any are in full force and effect.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 35977, Page 303.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
