Defendants Estate of Beulah Hershberger, Deceased, Unknown Spouse, if any, of Beulah Hershberger, Deceased, Unknown Executor or Administrator of the Estate of Beulah Hershberger, Deceased, and Unknown Heirs, Devisees and Legatees of the Estate of Beulah Hershberger, Deceased, whose addresses are unknown and who cannot be served within the State of Ohio, will take notice that Plaintiff filed a Complaint in Mortgage Foreclosure in the Court of Common Pleas of Stark County, Ohio on February 5, 2026 in Case No. 2026 CV 00252, against Linda K. Castro, et al., Defendants, alleging that on or about February 29, 2008, Plaintiff extended a loan to Defendant Linda K. Casto and Beulah Hershberger, who is now deceased; that pursuant thereto Defendant Linda K. Casto and Beulah Hershberger executed and delivered a certain Note (“the Note”) in the principal amount of $45,400.00; that Plaintiff is the holder of the Note, upon which there is due and owing $31,482.58, plus interest and other costs and expenses; that to secure payment of the Note, Defendant Linda K. Castro and Beulah Hershberger executed and delivered a Mortgage to Electronic Registration Systems, Inc. (“MERS”) solely as nominee for Plaintiff, and thereby conditionally conveyed to Plaintiff the real property described therein, and known as and located at 1724 Fulton Road, NW, Canton, Ohio 44703, Parcel No. 02-15897; that the Mortgage was assigned by MERS to Plaintiff; that the Assignment of Mortgage, and the Mortgage were properly recorded; that the Mortgage is the first and best lien against the subject real estate, after the lien of Defendant Stark County Treasurer for real estate taxes; that the Note secured by the Mortgage is in default for lack of payment, the conditions of the Mortgage have been broken, Plaintiff is the holder of the Mortgage and is entitled to have the Mortgage foreclosed; that Defendant Stark County Treasurer holds a claim on the subject real estate for real estate taxes; that Defendants Linda K. Castro, Unknown Spouse, if any, of Linda K. Castro, Estate of Beulah Hershberger, Deceased, Unknown Spouse, if any, of Beulah Hershberger, Deceased, Unknown Heirs, Legatees and Devisees of the Estate of Beulah Hershberger, Deceased, and Unknown Executor of the Estate of Beulah Hershberger, and Calvary SPV I, LLC, may have or claim to have interests in the subject real estate. The Complaint demands that the Defendants be required to appear and set forth whatever interests they may have in and to the subject real property or be forever barred from asserting the same; that Plaintiff obtain judgment in foreclosure; that the subject premises be appraised and sold in this action, and the proceeds applied to the satisfaction of Plaintiff’s Mortgage in its proper priority; and that the Court grant such other and further relief.
Defendants Estate of Beulah Hershberger, Deceased, Unknown Spouse, if any, of Beulah Hershberger, Deceased, Unknown Heirs, Legatees and Devisees of the Estate of Beulah Hershberger, Deceased, and Unknown Executor of the Estate of Beulah Hershberger, are further notified that they are required to answer said Complaint within twenty-eight (28) days of the last publication of this notice and set forth whatever interest they may have in and to the above-described real estate or be forever barred from asserting the same.
