NOTICE OF PROPOSED ORDINANCE
The City of Daytona Beach Shores, Florida, will hold Public Hearings to consider adoption of the following ordinance:
ORDINANCE NO. 2026-02
AN ORDINANCE OF THE CITY OF DAYTONA BEACH SHORES, FLORIDA, RELATING TO OUTDOOR DINING CONDITIONAL USES; AMENDING THE MUNICIPAL CODE OF ORDINANCES, APPENDIX G – LAND DEVELOPMENT CODE, BY AMENDING SECTION 14-58 ENTITLED "SPECIAL EXCEPTIONS AND CONDITIONAL USES" TO STREAMLINE AND CLARIFY THE APPLICATION AND APPROVAL PROCESS REQUIREMENTS FOR CONDITIONAL USES GENERALLY, AND BY AMENDING SECTION 14-58.2.1.A. ENTITLED "OUTDOOR DINING" TO STREAMLINE THE APPLICATION, APPROVAL, AND RENEWAL PROCESS FOR CERTAIN OUTDOOR DINING CONDITIONAL USES; PROVIDING FOR LEGISLATIVE FINDINGS AND INTENT; PROVIDING FOR ENFORCEMENT AND PENALTIES; PROVIDING FOR A SAVINGS PROVISION; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
The next Public Hearing is scheduled as follows:
City Commission (first reading): Tuesday, March 3, 2026, at 6:00 p.m.
The public hearings will be held in the City Commission Chambers in the Community Center located at 3000 Bellemead Drive, Daytona Beach Shores, Florida. The complete ordinance can be obtained from the office of the City Clerk located at 2990 S. Atlantic Avenue, Daytona Beach Shores, Florida.
All interested parties are invited to appear at the public hearings and submit oral or written objections or comments with respect to the proposed amendment. Anyone who wishes to appeal any decision by the Planning & Zoning Board or City Commission with respect to any matter considered at said public hearing will need a record of public hearing proceedings, including all testimony and evidence, and should arrange in advance for the making of a verbatim transcript of the public hearing. The public hearings may be continued to one or more dates. The dates, times, and places of any continuation of the public hearing will be announced at the location of the meeting and no further notice regarding said continuation is required to be published.
