By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Anne E. Farias and Leslie O. Farias to Mortgage Electronic Registration Systems, Inc., as nominee for Fremont Investment & Loan, its successors and/or assigns, dated September 14, 2006 and recorded with the Bristol County (Southern District) Registry of Deeds at Book 8315, Page 234, subsequently assigned to Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc. Trust 2007-HE3 by Mortgage Electronic Registration Systems, Inc., as nominee for Fremont Investment and Loan by assignment recorded in said Bristol County (Southern District) Registry of Deeds at Book 9549, Page 104, subsequently assigned to Deutsche Bank National Trust Company, as Trustee Morgan Stanley ABS Capital I Inc. Trust 2007-HE3 Mortgage Pass-Through Certificates, Series 2007-HE3 by Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc., Trust 2007-HE3 by assignment recorded in said Bristol County (Southern District) Registry of Deeds at Book 9887, Page 10 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on March 12, 2026 at 10 Kirby Road, Westport, MA, all and singular the premises described in said Mortgage, to wit:
The land with the buildings thereon situated in Westport, Bristol County, Massachusetts, bounded and described as follows:
Beginning at the Southwesterly corner of the premises herein conveyed at a point in the Northerly line of Kirby Road, said point being the Southeasterly comer of Lot 1 as shown on a Plan of land hereinafter mentioned; thence
SOUTH 77 degrees 37' 04" East in the said Northerly line of said Kirby Road sixty-seven and 70/100 (67.70) feet to an angle; thence
SOUTHEASTERLY still in the said Northerly line of Kirby Road nine and 42/100 (9.42) feet to a curve; thence
EASTERLY and NORTHEASTERLY in the arc of circle having a Radius of thirty and 00/100 (30.00) feet, forty-seven and 12/100 (47.12) feet to a point in the Northwesterly line of a proposed Street; thence
NORTH 22 degrees 45' 53" East in line of said proposed Street one hundred seventy and 00/100 (170.00) feet to land of now or formerly of Gerald Souza et ux; thence
NORTH 67 degrees 14' 07" West in line of last named land one hundred six and 01/100 (106.01) feet to the Northeasterly corner of said Lot 1; and thence
SOUTH 22 degrees 45' 53" West in line of last named Lot two hundred twelve and 20/100 (212.20) feet to the said Northerly line of Kirby Road and the point of beginning.

The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
