NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 7 Padelford Street, Berkley, MA 02779
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Gerald J. Shorrock and Pauline C. Shorrock to Bank of America, N.A., and now held by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Owner Trustee for Onity Loan Acquisition Trust 2024-HB2, said mortgage dated November 24, 2010 and recorded in the Bristol County (Northern District) Registry of Deeds in Book 19144, Page 195, said mortgage was assigned from Bank of America, NA to Champion Mortgage Company by assignment dated September 19, 2012 and recorded with said Registry of Deeds in Book 20468, Page 259; said mortgage was assigned from Nationstar Mortgage LLC dba Champion Mortgage Company to Bank of America, N.A. by assignment dated April 16, 2019 and recorded with said Registry of Deeds in Book 25042, Page 201; said mortgage was assigned from Bank of America, N.A. to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Owner Trustee for Onity Loan Acquisition Trust 2024-HB2 by assignment dated October 29, 2024 and recorded with said Registry of Deeds in Book 29092, Page 106; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on March 19, 2026 at 03:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land in Berkley, Bristol County, Massachusetts, on the southerly side of Padelford Street, and being shown on a plan drawn by Benjamin R. Evans entitled: "Plan of Land of Robert J. Lynch, Jr. and Katherine J. Lynch in Berkley Mass., Scale: 1 in = 100 ft.," which plan is duly recorded in Bristol County Northern District Registry of Deeds at Plan Book 174, Page 78.
Said parcel is further bounded and described as follows:
Beginning at the northwesterly corner of the described premises at a point in the southerly line of Padelford Street; it being the northeasterly corner of land conveyed to Bruce R. Gaspar, et al; and running thence by the southerly line of Padelford Street, easterly by a curve to the right having a radius of 800.00 feet a distance of 245 feet, more or less, to a concrete bound for a corner; thence by Subdivision lots S. 32 degrees W. 227.99 feet; thence S. 6 degrees 05' 30" W. 130 feet, more or less, to a Land Court disc: thence S. 66 degrees 31' E. 112.63 feet for a corner; thence by land now or formerly of C.G. Bettencourt by the following three courses. S. 3 degrees 52' W. 258 feet; S. 0 degrees 55' E. 109.12 feet; S. 6 degrees 10' E. 207 feet for a corner; thence still by said Bettencourt land N. 88 degrees 54' W. 378 feet for a corner; thence still by said Bettencourt land N. 1 degree 23' E. 276 feet and N. 2 degrees 01' E. 330.20 feet for a corner; thence S. 83 degrees 0' W. 119.56 feet for a corner; thence N. 3 degrees 30' W. 210.40 feet to land of Fruzzetti for a corner; thence N. 89 degrees 03' E. by Fruzzetti land 110.32 feet and by land of aforesaid Gaspar 199.91 feet for a corner; thence still by said Gaspar land N. 0 degrees 57' W. 208.73 feet to Padelford Street the point or place of BEGINNING.
Containing 7-1/2 acres, more or less.
Being the same premises conveyed by deed of Gerald J. Shorrock recorded 3/14/1979 in book 1899 page 42 in the Bristol (North) County Registry of Deeds
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated March 14, 1979 and recorded in the Bristol County (Northern District) Registry of Deeds in Book 1899, Page 42.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
