NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
Premises: 324 Payson Road, Belmont, Massachusetts
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Daniel A Dargon Jr. to Mortgage Electronic Registration Systems, Inc. ("MERS"), as mortgagee, as nominee for Guaranteed Rate Inc., its successors and assigns and now held by Lakeview Loan Servicing, LLC, said mortgage dated March 6, 2023, and recorded in the Middlesex County South Registry of Deeds in Book 81315, Page 543, as affected by an Assignment of Mortgage dated February 5, 2025, and recorded in the Middlesex County South Registry of Deeds in Book 83750, Page 333, of which mortgage the undersigned is the present holder, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on March 19, 2026 at 10:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon situated in said Belmont being Lot 9 as shown on Plan recorded with the Middlesex County South District Registry of Deeds in Plan Book 320, Plan 35, and bounded:
WESTERLY: by Payson Road, 43.33 feet;
NORTHWESTERLY: by the curved intersection of said road, with Fairview Avenue, by a curved line, 50.22 feet:
NORTHERLY: by Fairview Avenue, 56.94 feet;
EASTERLY: by parts of Lots Number 18 and Number 19 on said plan, 90.23 feet;
SOUTHERLY: by lot 8 on said Plan, 84.34 feet.
The above premises are conveyed with the benefit of and subject to the restrictions of record insofar same may be now applicable and in force.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor's Title see deed dated March 6, 2023, and recorded in the Middlesex County South Registry of Deeds in Book 81315, Page 540.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within forty-five (45) days after the date of sale.
