NOTICE OF SUCCESSOR TRUSTEE'S SALE
Default having been made in the payment of the debts and obligations as made, provided for and/or secured in a Deed of Trust executed by WESLEY WOODY to DORIS MATTHEWS, Trustee, dated April 23, 2021, and recorded on May 13, 2021 in Book 244, Pages 166-169 as Instrument/Document Number 40266 in the Register's Office for Meigs County, Tennessee, securing GARY GRAVES, and the entire indebtedness having been declared due and payable and payment not having been made as demanded.
WHEREAS, GARY GRAVES, as the Beneficiary of the Deed of Trust and as the lawful owner and holder of the debt instruments secured by the same, has removed DORIS MATTHEWS as Trustee, and appointed Estes & Kennedy Law Offices, PLLC as Successor Trustee by Appointment of Successor Trustee dated October 17, 2025, and recorded on October 23, 2025 in Book 284, Pages 604-606 in the Register's Office for Meigs County, Tennessee.
Notice is hereby given that Estes & Kennedy Law Offices, PLLC, Successor Trustee, having been appointed under the authority vested by said instrument, and having been requested to do so by the lawful holder and owner of said indebtedness will on March 18, 2026, at 10:00 AM Eastern Time, at the front door of the Meigs County Courthouse, 17200 State Highway 58 North, Decatur, Tennessee 37322, sell at public outcry, to the highest bidder and last bidder for cash, free from all statutory and other rights and equities of redemption to the extent provided for in T.C.A. 66-8-101, as amended and free from the rights of homestead and all other exemptions of any kind, which are waived in said Deed of Trust, but subject to any state tax liens and subject to any unpaid city or county property taxes and all other matters and encumbrances which take priority over the Deed of Trust under which this foreclosure sale is conducted, the following described property being located in Meigs County, Tennessee, and being more particularly described as follows:

LYING AND BEING in the Third Civil District of Meigs County, Tennessee, on Old Highway #68; in the Peakland Community, bounded on the North by now or formerly Adams, West by now or formerly Letner, South by Old Highway #68 and East by now or formerly Monday, being the Old Hickory Flat School property, and being more particularly described as follows:
BEGINNING at an iron pin corner in the northern edge of the right-of-way of Old Highway #68 with Mary Jane Letner (W.D.B. F-3, Pg. 507); thence with Letner, North 12 degrees 53 minutes East 280 feet to a corner with Adams; thence with Adams, North 89 degrees 20 minutes East 568.99 feet to an original rock pile corner with Raymond and Marylin Monday (W.D.B. R-2, Pg.771); thence first with Raymond and Marylin Monday and then with Ruth Monday (W.D.B. N-2, Pg. 623), South 26 degrees 05 minutes West 595.46 feet to an iron pin corner in the northern edge of the right-of-way of Old Highway #68; thence with the northern edge of the right-of-way of Old Highway #68, North 55 degrees 06 minutes West 365.18 feet to an iron pin; thence continuing with the northern edge of the right-of-way of Old Highway #68, 64.73 feet to curve in
right-of-way, thence continuing with the northern edge of right-of-way of Old Highway #68, North 62 degrees 45 minutes West 19.71 feet to the Point of Beginning, containing 4.8 acres, more or less.
EXCLUDED FROM THE ABOVE, however, is a tract conveyed to Mary Jane Letner Thomas by Quitclaim Deed recorded August 20, 2013 in Warranty Deed Book N5, page 451 and more particularly described as follows:
LYING AND BEING in the Third Civil District of Meigs County, Tennessee.
BEGINNING at an iron pin corner, same being the common corner of Letner, Peakland Road and the tract herein; thence leaving Peakland Road with Letner line North 11° 38' 10" East 274.59 feet to a point at Wood Heat Products Inc. line; thence with Wood Heat Products Inc. line North 88° 28'10" East 75.00 feet to an iron pin corner; thence South 25° 41'35" West 300.68 feet to the Beginning Corner, containing 0.23 acre, more or less.
THIS CONVEYANCE INCLUDES the right to obtain water for the purpose of gardening from the well located on Grantor's remaining property.
BEING the same property conveyed to Wesley Woody by Warranty Deed from Gary L. Graves, recorded in Warranty Deed Book H6, page 220 in the Register's Office for Meigs County, Tennessee.
The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter that an accurate survey of the premises might disclose; and all right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Successor Trustee.
NOTICE TO TENNESSEE DEPARTMENT OF REVENUE: This property is subject to State Tax Lien STL 10-119 recorded in Book 10, Page 119, Meigs County Register's Office. Notice has been provided to the Tennessee Department of Revenue as required by TCA § 67-1-1433. The State of Tennessee has a one-year right of redemption following the foreclosure sale.
NOTICE TO INTERESTED PARTIES: Notice has been sent by certified mail to: (1) Juden Elbert Poore Jr, current record owner; (2) Wesley Woody, original borrower; (3) Republic Finance, LLC (judgment creditor, Book 9, Page 316); and (4) CBBC, LLC (judgment creditor, Book 9, Pages 582-583). Any person having an interest in the property should contact the Successor Trustee immediately.
PROPERTY TAXES: 2024 property taxes in the amount of $1,718.10 are delinquent. Property tax liens have priority over all other liens and will survive this foreclosure sale.
No warranties or representations are made as to the marketability of title to said real property, which real property is being sold "where is, as is", subject to all restrictions, easements, unpaid real property taxes, assessments, and all superior encumbrances and liens, if any, whether of record or not. The undersigned shall convey only as Successor Trustee without covenants or warranty of title. This is an action to collect a debt and any information obtained will be used for this purpose.
Should the highest bidder fail to comply with the terms of the bid at the public sale, then the Successor Trustee shall have the option of accepting the next highest bid with which the buyer is able to comply. The right is reserved to adjourn the day of the sale to another day certain without further publication, upon announcement at the time set forth above. The sale held pursuant to this notice may be rescinded by the Successor Trustee's option at any time.
