NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 49 Yale Avenue, Plymouth, MA 02360
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Andrew Sampson to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Embrace Home Loans, Inc., and now held by Freedom Mortgage Corporation, said mortgage dated December 15, 2017 and recorded in the Plymouth County Registry of Deeds in Book 49302, Page 154, as affected by a Loan Modification dated August 29, 2024 and recorded in the Plymouth County Registry of Deeds in Book 59301, Page 31; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Embrace Home Loans, Inc. to Freedom Mortgage Corporation by assignment dated March 15, 2022 and recorded with said Registry of Deeds in Book 56560, Page 55; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on March 27, 2026 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land at 39 Yale Avenue, Plymouth, Plymouth County, Massachusetts, being shown as Lot 79 on a plan entitled "Pilgrim's Bridge, Section III, Subdivision Plan of Land in Plymouth, for Ann Rita O'Meara, Trustee", dated February 16, 1971, by Lamonte R. Healey, Inc., Land Surveyors, recorded with Plymouth Deeds, Plan Book 16, Page 289.
SAID PREMISES ARE SUBJECT TO THE FOLLOWING ENCUMBRANCES:
1. Easement to New Bedford Gas and Edison Light Company and New England Telephone and Telegraph Company, dated March 27, 1973, recorded with said Deeds, Book 3877, Page 492.
2. Rights set forth in a Stipulation, recorded with said Deeds, Book 3998, Page 800.
3. Order of Taking by the Town of Plymouth for the layout of Yale Avenue, dated June 2, 1981, recorded with said Deeds, Book 5004, Page 140.
4. Easement to Plymouth County Electric Company, dated June 19, 1961, recorded with said Deeds, Book 2858, Page 165, more particularly shown on the above mentioned plan.
5. Easement to New Bedford Gas and Edison Light Company and New England Telephone and Telegraph Company, dated May 23, 1966, recorded with said Deeds, Book 3303, Page 696.
6. Easement to New England Telephone and Telegraph Company and New Bedford Gas and Edison Light Company, dated September 3, 1968, recorded with said Deeds, Book 3470, Page 317.
7. Easement to New Bedford Gas and Edison Light Company, dated August 31, 1968, recorded with said Deeds, Book 3468, Page 123.
Being the same premises conveyed to the herein named mortgagor (s) by deed recorded with Plymouth County Registry of Deeds herewith.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated December 12, 2017 and recorded in the Plymouth County Registry of Deeds in Book 49302, Page 151.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
