NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Commercial Mortgage, Security Agreement, Assignment of Leases and Rents and Fixture Filing dated November 19, 2024 given by Vineyard Sound View LLC to RD WAB SPV LLC, said mortgage recorded with the Barnstable County Registry of Deeds in Book 36683 Page 273, and which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. on the 23rd day of March, 2026 at 286 Grand Avenue, Falmouth, Massachusetts, all and singular the premises described in said mortgage.

Condominium unit known as "Unit 2" in the Casino Wharf Condominium, a condominium established pursuant to Massachusetts General Laws, Chapter 183A, by Master Deed dated June 27, 2006 and recorded with the Barnstable County Registry of Deeds on June 29, 2006 in Deed Book 21142, Page 242 and managed and regulated by the Trustees of the Casino Wharf Condominium Trust under a Declaration of Trust, dated June 27, 2006 and recorded with the Barnstable County Registry of Deeds on June 29, 2006 in Deed Book 21142, Page 286. The Unit is shown on floor plans recorded simultaneously with the Master Deed and also on a copy of a portion of the Floor Plans attached to the Unit Deed dated August 4, 2006, and recorded with Barnstable County Registry of Deeds in Deed Book 21303, Page 54 and made a part hereof, to which is affixed the verified statement of a registered architect in the form required by Section 9 of said Chapter 183A.

The Unit is conveyed together with the benefit of:
An exclusive right and easement appurtenant to the Unit to use the following defined areas shown on the Site Plan and identified as Limited Common Elements in Section 6(b): Dedicated Parking Spaces as shown on the Site Plan;An easement for the continuance of all encroachments by the Unit on any adjoining units or common areas and facilities existing as a result of construction of the building in which the Unit is located, or which may come into existence hereafter as a result of settling or shifting of said building, or as a result of repair or restoration of said building or of the Unit, after damage or destruction by fire or other casualty, or after taking in condemnation or eminent domain proceedings, or by reason of any alteration or repair to the common areas and facilities made by or with the consent of the Trustees of the Condominium Trust;An easement in common with the owners of other Units to use any pipes, wires, ducts, flues, cables, conduits, public utility lines and other common facilities located in any of the other Units or elsewhere on the Condominium property which serve the Unit; andThe benefit of any other rights described in the Master Deed as being appurtenant to the Units.
The Unit is conveyed subject to:
1. An easement in favor of adjoining Units and in favor of the common areas and facilities for the continuance of all encroachments of such adjoining Units or common areas and facilities into the Unit, now existing as a result of construction of said building in which the Unit is located, or which may come into existence hereafter as a result of settling or shifting of said building, or as a result of repair or restoration of said building or of any adjoining Unit or of the common areas and facilities after damage or destruction by fire or other casualty, or after taking in condemnation or eminent domain proceedings, or by reason of any alteration or repair to the common areas and facilities made by or with the consent of the Trustees of the Condominium Trust;
2. The provisions of: (i) the Master Deed (and the Floor Plans of the Condominium recorded simultaneously with and as part of the Master Deed, including, without limitation, all matters set forth or referred to in Exhibit A to the Master Deed); (ii) the Declaration of Trust; and (iii) Massachusetts General Laws, Chapter 183A. The Master Deed and Declaration of Trust may be amended from time to time by instrument recorded with Barnstable County Registry of Deeds, and the provisions thereof shall constitute covenants running with the land and shall bind any person having at any time any interest or estate in the Unit, or the parking space(s), his family, servants and visitors, as though such provisions were recited and stipulated at length herein; and
An easement in favor of other Units to use any pipes, wires, ducts, flues, cables, conduits, public utility lines and other common facilities located in the Unit and serving other Units.

Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens and rights of any tenants and parties in possession, if there be any, or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. The successful bidder will pay all costs of recording the foreclosure deed and any other foreclosure documents including, without limitation, all state and county excise stamp fees, and shall also be responsible for any Title V inspection and repair requirements.
Terms of sale: A deposit of Twenty-Five Thousand and 00/100 Dollars ($25,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check to Mirrione, Shaughnessy & Uitti, LLC, 2 Batterymarch Park, Suite 202, Quincy, MA 02169 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
