TO THE ABOVE-NAMED DEFENDANT:
You are notified that on the 18th day of November, 2025, a Petition was filed in the Office of the Clerk of Court for Polk County, Iowa naming you as a Defendant in the above-captioned action. The Petition prays that the property legally described as: E 148.58F MEAS ON S LN LT 37 ORP SEC 5-78-23; AND -EX BEG 148.58F W OF N 1/4 COR OF SEC 8-78-23 THN S 16.66F NWLY ALNG CRV 292.3F TO N LN E TO POB- BEG N 1/4 COR SEC 8 THN S27.9F NWLY 441.9F E TO POB LT 3 PARTITION PLAT OF LYSANDERS HARVEYS ESTATE, an Official Plat, now included in and forming a part of the City of Des Moines, Polk County, Iowa, and locally known as 4201 Scott Avenue, Des Moines, Iowa, is in violation with the Municipal Code of the City of Des Moines, Chapter 135 Section 2.22.2.C. Further, Plaintiff prays the Court order the Defendant to remove the outbuildings and detached garage. Further, the Plaintiff requests that the court assess in rem against the property for the costs of this action and the costs incurred in the enforcement of the Municipal Code of the City of Des Moines, Iowa, inclusive of any costs incurred in the abatement of the property, all with interest. Further, the Plaintiff requests that any Defendant who holds an interest by virtue of a lien or mortgage be ordered to allow the abatement of the public nuisance.
