NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Gercide Luc to Mortgage Electronic Registration Systems, Inc., as Nominee for Capital One, N.A., dated November 30, 2016, and recorded with the Plymouth County Registry of Deeds in Book 47819 at Page 233, of which mortgage the undersigned is the present holder by an assignment of mortgage From Mortgage Electronic Registration Systems, Inc., as Nominee for Capital One, N.A., to Wilmington Savings Fund Society, FSB, as Trustee of Stanwich Mortgage Loan Trust A, dated January 31, 2019, and recorded with said Deeds in Book 50775, Page 281; by an assignment of mortgage From Wilmington Savings Fund Society, FSB, as Trustee of Stanwich Mortgage Loan Trust A to U.S. Bank Trust National Association, as Trustee of the Lodge Series IV Trust, dated October 19, 2020, and recorded with said Deeds in Book 53805, Page 77; and by assignment of mortgage From U.S. Bank Trust National Association, as Trustee of the Lodge Series IV Trust to US Bank Trust National Association as Trustee of the Bungalow Series IV Trust dated March 12, 2021, and recorded with said Deeds in Book 54671, Page 43. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 A.M. on the 31st day of March 2026, at 120 Anawan Street, Brockton, MA 02302, all and singular the premises described in said mortgage,
To wit:
The land in Brockton, Plymouth County, Massachusetts with the buildings and improvements, situate on the westerly side of Donna Street and on the northerly side of Anawan Street, and being shown as Lot 5106A on plan entitled “Revision Plan, Brockton, Mass., Owned by Campanelli, Inc., Scale 1”= 40’, September 20, 1968, Bradford Saivetz & Associates, Inc. Consulting Engineers”, recorded with the Plymouth County Registry of Deeds in Plan Book 14, Page 1105.
Said lot is bounded and described as follows:
Southerly by said Anawan Street, as shown on said plan, eighty-seven and 26/100 (87.26) feet; Westerly by two courses, as shown on said plan, for a distance of one hundred thirty and 72/100 (130.72) feet; Northerly by Lot 5105A, as shown on said plan, one hundred thirteen and 83/100 (113.83) feet; and Easterly by said Donna Street, as shown on said plan, one hundred seventeen and 64/100 (117.64) feet; and Southeasterly in a curve at the intersection of said Donna Street and Anawan Street, thirty-five and 75/100 (35.75) feet.
Said Lot 5106A contains, according to said plan, 13,086 square feet of land, more or less.
The premises is conveyed subject to a taking by the City of Brockton for the layout of Anawan Street recorded with the Plymouth County Registry of Deeds in Book 34920, Page 259.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
