Project Description:
The applicant proposes to import 400,000 to 500,000 CY of uncontaminated fill from a nearby construction site into the existing mine over an approximately 16-week period during the 2026 construction season. The importation of uncontaminated material into the mine was previously reviewed and approved. However, the applicant is proposing to modify their Mined Land Reclamation Permit by changing the reclamation plan to fill approximately 14 acres of a 19-acre reclamation pond within the existing 51.7-acre Life of Mine (LOM). The applicant also proposes to construct a new 7-foot-high berm, as a precautionary measure, at the west end of the pond that will be filled; this berm will be within the existing LOM. Additionally, the applicant is proposing several temporary permit modifications; after the material importation and pond filling are complete, the mining operations will return the previously authorized conditions. The proposed temporary modifications are as follows:
1. Temporarily increase the hours of operation to 7:00 AM – 8:00 PM Monday through Saturday. This is a change from the previously authorized hours of operation, which were 7:00 AM – 5:30 PM Monday through Friday, and 7:00 AM – 3:00 PM Saturday. There are no proposed hours of operation on Sundays or holidays.
2. Temporarily increase truck traffic to up to 50 trucks per hour (up to 500 truck trips per day), up from the currently approved 20 trucks per hour (up to 200 truck trips per day).
3. The Permit Term Area (PTA) would temporarily be increased to 29.2 acres (ac), up from the current PTA of 15.2 ac.
There are no proposed changes to the LOM. Mining will continue to occur below the water table.

State Environmental Quality Review (SEQR) Determination
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other involved agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination
A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
