ORDER FOR SERVICE OF PROCESS BY PUBLICATION
At a session of court held in the courthouse in Port Huron, Michigan, St. Clair County, on 2/6/2026,
Present: Honorable Cynthia A. Lane, 31st Circuit Court Judge
After reviewing the Plaintiffs Motion for Service of Process by Publication, this Court finds that Plaintiff has shown that service of process cannot reasonably be made on Defendant Charles Andrew Strachan by the methods provided in MCR 2.105(A), because he is deceased.
The Court further finds, pursuant to MCR 2.105(J)(1) and MCR 2.106(D), that service of process by publication is the best available method reasonably calculated to give actual notice of the proceedings and an opportunity to be heard. Mailing is not required under MCR 2.105(D)(2).
IT IS ORDERED:.
1. Plaintiff may serve process on Defendants by publishing the following notice once each week for a period of three consecutive weeks in the Port Huron Times Herald, which is a newspaper as defined in MCR 2.106(F) that is published in the county where the action in pending and where the real property that is the subject of the action is located:
"An action to reform the deed and to quiet title to the real property located in the City of Port Huron, St. Clair County, Michigan, more fully described as:
Lot 27, including 1/2 of vacated alley adjacent thereto, BOYCE PLAT, as recorded in Liber 32 of Plats, page 4, St. Clair County Register of Deeds Office
has been commenced by Plaintiff Linda Deman against Defendant CHARLES ANDREW STRACHAN in the St. Clair County Circuit Court for the State of Michigan, in Case Number 26-000071-CH and Defendant or any other party seeking to claim an interest in the property described above must answer or take other action permitted by law within 28 days after the last date of publication. If Defendant does not answer or take other action within the time allowed, judgment may be entered against Defendant for the relief demanded in the complaint."
2. Proof of Publication shall be filed with this Court.
