SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on March 10, 2025, 316 Capital Enterprises LLC, Steven Brice, Manager, executed a deed of trust to T.D. Service Company, Trustee for the benefit of Velocity Commercial Capital, LLC, which deed of trust is recorded in Deed of Trust Book 7320 at Page 5319 in the Office of the Chancery Clerk of the First Judicial District, County of Hinds, State of Mississippi; and
WHEREAS, said Deed of Trust was last sold, assigned and transferred to U.S. Bank Trust Company, National Association, as Trustee for Velocity Commercial Capital Loan Trust 2025-3 by assignment recorded July 24, 2025 in Book 7321 at Page 5246 in the Office of the aforesaid Chancery Clerk; and
WHEREAS, U.S. Bank Trust Company, National Association, as Trustee for Velocity Commercial Capital Loan Trust 2025-3, the holder of the Deed of Trust and the note secured thereby, substituted McCalla Raymer Leibert Pierce, LLP as Trustee therein, as authorized by the terms thereof, by instrument dated November 20, 2025 and recorded in the Office of the aforesaid Chancery Clerk in Book 7330 at Page 5910; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby having been declared due and payable, in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness, U.S. Bank Trust Company, National Association, as Trustee for Velocity Commercial Capital Loan Trust 2025-3, having requested the undersigned Substitute Trustee to execute the trust and sell the land and property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with attorney’s fees, Substituted Trustee’s fees and expense of sale.
NOW, THEREFORE, WE, McCalla Raymer Leibert Pierce, LLP, Substituted Trustee under the Deed of Trust, will on the 25th day of March, 2026, offer for sale at public outcry and sell to the highest bidder for cash within legal hours (between 11:00 a.m. and 4:00 p.m.) at the North front door of the Hinds County Courthouse located in Jackson, Mississippi, the following described property situated in the First Judicial District of Hinds County, Mississippi, being the same property described in the Deed of Trust:
Lot 9, Block 17, Woodville Heights, Part 9A, a subdivision according to a map or plat thereof which is on file and of record in the Office of the Chancery Clerk of Hinds County at Jackson, Mississippi, in Plat Book 12 at Page 25, reference to which is hereby made in aid of and as a part of this description.
WE WILL CONVEY only such title as is vested in McCalla Raymer Leibert Pierce, LLP as Substituted Trustee.
