Under and by virtue of the power of sale in a certain Deed to Secure Debt from 423 EAST RIVER STREET, LLC, Grantor, to MORRIS BANK, Grantee, dated the 12th day of June, 2024 and recorded in Deed Book 3403, Page 469, Clerk's Office, Chatham County Superior Court, said Deed to Secure Debt having been given to secure a Commercial Promissory Note dated the 12th day of June, 2024 in the sum of $6,526,239.65, there is due to be sold by the undersigned at public outcry, during the legal hours of sale on the first Tuesday in April, 2026, to-wit: the 7th day of April, 2026, to take place at the steps of the Chatham County Courthouse, Savannah, Georgia, to the highest and best bidder for cash, the following described property:
ALL THAT LOT, TRACT OR PARCEL OF LAND LYING, situate and being in Savannah, Chatham County, Georgia, and known as the Eastern portion of Wharf Lot 5 and the Western portion of Wharf Lot 6, East of Lincoln Street and being more particularly described as follows: Beginning at a point on the southwest corner of the intersection of East River Street and an alley between the western portion of Wharf Lot 6 and the eastern portion of said lot; thence proceeding South 17°28' West along the western line of said alley a distance of 52.1 feet to a point located at the northwest corner of said alley and Factor's Walk; thence proceeding North 71°45' West along the northernmost boundary of Factor's Walk a distance of 140.93 feet to a point; thence proceeding North 17°00' East a distance of 50.9 feet to a point on the southernmost boundary of East River Street; thence proceeding along said southernmost boundary of East River Street South 72°15' East a distance of 141.35 feet to the point of beginning; being bounded on the North by East River Street; on the East by an alley between the western portion of Wharf Lot 6 and the eastern portion of Wharf Lot 6; on the South by East Factor's Walk; and on the West by the remaining portion of Wharf Lot 5, East of Lincoln Street; all of which will more particularly appear on a plat of said above described property showing said metes and bounds made for Sea Cabin Corporation, referred to on said plat as "Sea Cabins", by Barrett and Exley, Inc., Surveyors, dated December 21, 1977 and recorded in Chatham County records in Plat Book BB, Page 97, which is incorporated herein by reference for a more perfect description. The eastern portion of said Wharf Lot 5 and the western portion of said Wharf Lot 6 is also shown a more recent plat prepared by Joseph J. Stuckey, Jr. RLS dated March 8, 2006 and recorded in Plat Book 34-P, Page 6 which plat is also incorporated herein and made a part hereof by reference. This being the same property as conveyed to Factors River, Inc. under Trustee's Deed dated June 15, 2000 recorded in Deed Book 213-A, Page 63, Chatham County, Georgia Superior Court records and bearing current Chatham County tax assessor PIN 2-0004-2-004.
The debt secured by said Deed to Secure Debt and Note has been and are hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given to enforce provisions for collection of attorney's fees and foreclosure in accordance with the legal requirements and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including the attorney's fees and the remainder, after applying said proceeds to other indebtednesses owed by Grantor to Grantee, if any, shall be applied as provided by law.
To the best of the undersigned's knowledge and belief, the property is in the possession of 423 EAST RIVER STREET, LLC and said property will be sold as the property of 423 EAST RIVER STREET, LLC. Said property will also be sold subject to all outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any, unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Deed to Secure Debt first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in the Deed to Secure Debt. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
