NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 243 Oak Grove Avenue, Fall River, MA 02723
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Manuel C. Gomes to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for NFM, Inc. dba NFM Lending, and now held by NewRez LLC d/b/a Shellpoint Mortgage Servicing, said mortgage dated January 21, 2020 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 9997, Page 23, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for NFM, Inc. dba NFM Lending to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment dated February 14, 2025 and recorded with said Registry of Deeds in Book 11712, Page 345; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 2, 2026 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
Parcel of land in Fall River, Bristol County, Massachusetts, together with the buildings and improvements thereon, being further described as follows:
Being shown as Lot #1 on plan of land entitled "Approval Not Required Plan of Land in Fall River, MA. Prepared for Lawrence Souza" Scale 1" = 20' Assessor's Plat L-12, Lot 44, 45 dated December 2, 2004 and recorded at the Bristol County Fall River District Registry of Deeds in Plan Book 133, Page 57. Said Lot #1 containing 7,912 square feet.
Subject to a Decision of the Fall River Zoning Board of Appeals recorded at said Registry of Deeds in Book 5703, Page 331.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated January 21, 2020 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 9997, Page 21.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
