MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage dated August 11, 2023, from Robert L. Stefan, Jr. and Brandi L. Stefan to Eastern Bank recorded with the Plymouth County Registry of Deeds in Book 58309, Page 337, the undersigned Eastern Bank being the present holder of said mortgage, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same, will be sold at Public Auction at:
2:00 PM, Tuesday, April 7, 2026
upon the hereinafter-described premises, known as and numbered as 945 Long Pond Road, Plymouth, Plymouth County, Massachusetts, all and singularly the premises described in said mortgage, to wit:
The land with the buildings thereon situated on the Westerly side of Long Pond Road in Plymouth. Plymouth County, Massachusetts, bounded and described as follows: SOUTHEASTERLY by lot 11 as shown on the hereinafter mentioned plan, two hundred seventy-seven and 39/100 (277.39) feet; SOUTHWESTELY by land now or formerly of Warner D. Eldridge et al, one hundred fourteen and no/ 100 (114.00) feet; NORTHWESTERLY by Lot 13 as shown on said plan, three hundred twenty and 25/100 (320.25) feet; EASTERLY by said Long Pond Road, one hundred twenty and no/100 (120.00) feet. Said parcel containing .71 acres and being shown as Lot 12 on a certain plan entitled: "Subdivision at Little Herring Pond, Plymouth, Mass. Land Belonging to William W. Halt and Parker L. Barnes. Scale 1” = 100’ Feb. 8, 1971 by Westgate Associates, Rochester Road, So. Carver, Mass., which plan is recorded with Plymouth County Registry of Deeds in Plan Book 15, Page 937. Said premises are subject to restrictions set forth in a deed from Robert L. Shea to William W. Hall and Parker L. Barnes dated April 1, 1971 and recorded with said Deeds Book 3659, Page 641, insofar as the same are in force and applicable.
Being the same parcel conveyed to Robert L. Stefan, Jr. and Brandi L. Stefan, from Robert L. Stefan, Sr. and Elizabeth I. Stefan, married to each other, by virtue of a deed dated 08/21/2020, recorded 08/28/2020 in Book 53335 Page 249 in Plymouth County, State of Massachusetts.
Said above-described premises shall be sold subject to the first mortgage from Robert L. Stefan, Jr. and Brandi L. Stefan to Mortgage Electronic Registration Systems, Inc., as nominee for Embrace Home Loans, Inc., its successors and assigns, dated August 28, 2020, in the original principal amount of $370,000.00, recorded with Plymouth County Registry of Deeds in Book 53335, Page 251, as assigned of record.
The above-described premises shall be subject to all easements, restrictions, municipal or other public taxes, assessments, liens or claims in the nature of liens, outstanding tax titles, building, zoning and other land use laws and all permits and approvals issued pursuant thereto, including, without limitation, orders of conditions, and existing encumbrances of record created prior to said Mortgage, if there be any. Said premises are to be sold subject to the right of redemption of the United States of America, if any there be.
TERMS OF SALE: The highest bidder shall be required to make a deposit of $10,000.00 to the holder of said Mortgage, in cash or by certified or bank cashier's check at the time and place of said sale of said premises. The balance of the purchase price is to be paid to said holder in cash, by certified check or bank cashier's check, and thereupon the deed shall be delivered, in thirty (30) days from the date of sale at the firm of Cunningham, Machanic, Cetlin, Johnson, Harney & Tenney, LLP, Attorneys for said holder, 220 North Main Street, Suite 301, Natick, Massachusetts. The successful bidder shall be required to sign a Memorandum of Terms of Sale. The description of the premises contained in said Mortgage shall control in the event of an error in publication.
