MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
20 ASH STREET, MIDDLEBORO, MA 02346
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Melissa Willette to Citizens Bank, N.A., dated July 23, 2022 and recorded in Plymouth County Registry of Deeds in Book 57110, Page 259, of which mortgage the undersigned is the present holder for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on March 30, 2026 at 12:00PM local time upon the premises 20 ASH STREET, MIDDLEBORO, MA 02346, all and singular the premises described in said Mortgage, to wit:
A CERTAIN PARCEL OF LAND SITUATED ON THE SOUTH SIDE OF CENTER STREET AND THE NORTH SIDE OF ASH STREET, IN MIDDLEBORO, PLYMOUTH COUNTY, MASSACHUSETTS AND BEING SHOWN AS LOT 9 ON A PLAN ENTITLED PLAN OF LAND IN MIDDLEBORO, MA OWNER JOSEPH J. SAGESTA SCALE 1 INCH EQUALS TO 40 FEET DATE: NOV 28, 1995 JEFFERY D. YOUNGQUIST, P.L.S 302 QUAKER MEETINGHOUSE ROAD, E. SANDWICH, MA SAID LOT 9 IS MORE PARTICULARLY BOUNDED AND DESCRIBED ACCORDING TO SAID PLAN AS FOLLOWS:
BEGINNING AT A POINT ON THE NORTHERLY SIDE OF ASH STREET AND BEING THE SOUTHWESTERLY CORNER OF THE PARCEL HEREIN DESCRIBED; THENCE NORTH 28 SECONDS 51 MINUTES 39 SECONDS EAST BY LAND NOW OR FORMERLY OF VERNARD HAIRSTON AND NOW OR FORMERLY OF HOWARD AND CHERYL LADD A DISTANCE OF 299.35 FEET TO A CORNER AND CENTER STREET; THENCE SOUTH 65 SECONDS 30 MINUTES 40 SECONDS EAST BY SAID CENTER STREET A DISTANCE OF 557.31 FEET TO A POINT; THENCE STILL BY SAID CENTER STREET BY A CURVE TO THE RIGHT WITH A RADIUS OF 31.00 FEET A DISTANCE OF 84.24 FEET TO A COUNTY BOUND AND ASH STREET AS SHOWN ON SAID PLAN; THENCE NORTH 87 SECONDS 29 MINUTES 05 SECONDS WEST BY SAID ASH STREET, A DISTANCE OF 639.30 FEET TO A CORNER AND THE PLACE AND POINT OF BEGINNING. SAID LOT 9 CONTAINS 103,365 SQUARE FEET ACCORDING TO SAID PLAN.
The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described.
TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof.
