Palumbo, Jr. to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Franklin American Mortgage Company, its successors and assigns, dated May 29, 2009 and recorded in Bristol County (Fall River District) Registry of Deeds in Book 7192, Page 214 (the “Mortgage”), as affected by a Loan Modification Agreement dated September 13, 2016, and recorded at said Registry of Deeds in Book 9077, Page 217 of which mortgage U.S. Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For RCF 2 Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Franklin American Mortgage Company, its successors and assigns to Wells Fargo Bank, N.A. dated August 30, 2011 and recorded at said Registry of Deeds in Book 7741, Page 347, and Assignment from Wells Fargo Bank, N.A. to Secretary of Housing and Urban Development dated July 31, 2013 and recorded at said Registry of Deeds in Book 8386, Page 110, and Assignment from Secretary of Housing and Urban Development to CP-SRMOF II 2012-A Trust, U.S. Bank Trust National Association, not in its individual capacity but solely as Trustee dated October 17, 2013 and recorded at said Registry of Deeds in Book 8386, Page 113, and Assignment from CP-SRMOF II 2012-A Trust, U.S. Bank Trust National Association, not in its individual capacity but solely as Trustee to Wilmington Savings Fund Society, FSB D/B/A Christiana Trust, not in its individual capacity but solely in its capacity as Certificate Trustee for NNPL Trust Series 2012-1 dated October 30, 2018 and recorded at said Registry of Deeds in Book 9650, Page 211, and Assignment from Wilmington Savings Fund Society, FSB D/B/A Christiana Trust, not in its individual capacity but solely in its capacity as Certificate Trustee for NNPL Trust Series 2012-1 to Wilmington Savings Fund Society, FSB, not in its individual capacity, but solely as Owner Trustee for NRPL Trust 2019-3 dated December 3, 2020 and recorded at said Registry of Deeds in Book 10362, Page 47, and Assignment from Wilmington Savings Fund Society, FSB, not in its individual capacity, but solely as Owner Trustee for NRPL Trust 2019-3 to U.S. Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For RCF 2 Acquisition Trust dated March 17, 2025 and recorded at said Registry of Deeds in Book 11747, Page 217, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 458 Maple Street, Fall River, MA 02720 will be sold at a Public Auction at 11:00 AM on March 30, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in Fall River, Bristol County, Massachusetts, with all buildings and improvements thereon, bounded and described as follows:
Beginning at the northeast corner of the junction of High and Maple Streets and at the southwest corner of the lot to be conveyed; thence easterly by said Maple Street one hundred eight and 90/100 (108.90) feet to Highland Avenue for a corner; thence northeasterly by said Highland Avenue one hundred eight and 44/100 (108.44) feet to land formerly of Elizabeth S. Hawkins for a corner; thence westerly by said land formerly of Elizabeth S. Hawkins and other land of Elizabeth S. Hawkins one hundred sixty and 07/100 (160.07) feet to High Street aforesaid for a corner; thence southerly by said High Street ninety-four and 06/100 (94.06) feet to the point of beginning, containing forty-six and 79/100 (46.79) rods of land, more or less.
For mortgagor’s title see deed recorded with the Bristol County (Fall River District) Registry of Deeds in Book 7192, Page 212.
The property will be sold subject to the redemption rights in favor of the Internal Revenue Service by virtue of the tax lien(s) recorded in Bristol County (Fall River District) Registry of Deeds in Book 9759 and Page 327.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
