MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Leo Partosan and Roni Partosan to Option One Mortgage Corporation, dated May 24, 2006 and recorded in Norfolk County Registry of Deeds in Book 23703, Page 60 (the “Mortgage”), as affected by a Loan Modification Agreement dated May 14, 2008, and recorded at said Registry of Deeds in Book 26002, Page 407 of which mortgage HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2006-OP2 is the present holder by Assignment from Option One Mortgage Corporation to HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2006-OP2 dated June 19, 2013 and recorded at said Registry of Deeds in Book 31622, Page 367, and Corrective Assignment from Sand Canyon Corporation f/k/a Option One Mortgage Corporation to HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2006-OP2 dated December 20, 2017 and recorded at said Registry of Deeds in Book 35721, Page 84, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 56 Lunar Avenue, Braintree, MA 02184 will be sold at a Public Auction at 10:00 AM on March 30, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Being known and designated as a certain parcel of land with the buildings thereon now know as and numbered 56 Lunar Avenue, situated in Braintree, Norfolk County, Massachusetts, being the greater portion of Lot 33 on a plan by Ernest W. Branch, Inc., dated April 14, 1962, recorded with Norfolk Deeds, Book 4029, Page 60, bounded and described as follows:
WESTERLY by Lunar Avenue, one hundred (100) feet;
NORTHERLY by lot 34 on said plan by two lines, fifty-five (55) feet; and one hundred and thirty-eight hundredths, (100.38) feet;
EASTERLY by the remaining portion of said lot 33, eighty-two and seven hundredths, (82.07) feet;
SOUTHERLY by lot 32 on said plat one hundred sixty-eight and 41 hundredths (168.41) feet.
Containing, fifteen thousand (15,000) square feet of land, more or less.
For mortgagor’s title see deed recorded with the Norfolk County Registry of Deeds in Book 23703, Page 59.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
