MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Elite Real Estate Holdings Co. to Steven A. Ross, Trustee of QS Lending Two Trust, dated May 23, 2024 and recorded on May 28, 2024 with the Worcester County (Southern District) Registry of Deeds in Book 70556, Page 293 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of a certain parcel of land with the buildings and improvements thereon located in Auburn known as 7 Duncan Street, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 10:00AM on the 7th day of April 2026, at the mortgaged premises located at 7 Duncan Street, Auburn, Worcester County, Massachusetts, all and singular the premises described in said mortgage.
To wit:
The land in Auburn, Worcester County, Massachusetts on the northerly side of Duncan Street, and being Lot 21 as shown on a “Plan of House Lots in Auburn, Mass.” Drawn November 1, 1948 and recorded with the Worcester District Registry of Deeds, Plan Book 155, Plan 99 and bounded and described as follow:
BEGINNING at the southeasterly corner thereof at the southwesterly corner of land of Donald Keyes on the northerly side of said Duncan Street;
THENCE North 80 degrees 30’ West seventy-five (75) feet along the northerly line of said Duncan Street to the southeasterly corner of Lot 17 as shown on said plan;
THENCE North 9 degrees 30’ East two hundred thirty-two (232) feet more or less along easterly line of said Lot 17 as shown on said plan to center of a stone wall, at land of James L. Morelly;
THENCE Easterly seventy-five and thirty-two hundredths (75.32) along the center of said stone wall by land of said stone wall by land of said Morelly to the northwesterly corner of said Keyes land it being the southwesterly corner of land of William and Eva Simisky;
THENCE South 9 degrees 30’ West two hundred twenty-six (226) feet more or less (incorrectly recited in foreclosure deed, dated April 22, 1981 and recorded in said Registry of Deeds at Book 13355, Page 272, as “two hundred twenty (22.5) Feet” by land of said Keyes to the place beginning contacting 17,175 square feet of land more or less.
Being a part of the second tract of land described in said deed given to Arthur N. Pond et ux, by H. Carroll Pond dated March 1, 1904 and recorded with the said Registry of Deeds, Book 1804, Page 402.
Also being a part of the premises conveyed to Arthur N. Pond and Mary J. N. Pond as tenant by the entirety, said Mary having deceased June 12, 2952, see Worcester Probate Court case 171368 by deed of Ellen C. Fray dated December 11, 1942 and recorded with said Registry of Book 2874, Page 443.
Also another parcel of land in said Auburn adjoining the above described tract and further bounded and described as follows:
BEGINNING at the southwesterly corner thereof at the southeasterly corner thereof at the southeasterly corner of Lot 14 on the above mentioned plan;
THENCE South 66 degrees 27’ Esat by northerly line of said Duncan Street four and eighty-three hundredths (4.83) feet to an angle in said Street;
THENCE South 80 degrees 30’ East by the northerly line of Duncan Street seventy and twenty-two hundredths (70.22) feet to a point of Lot 21 on said plan;
THENCE Westerly along the center of said stone wall by said Morelly land seventy-five and three tenths (75.3) feet to a point at Lot 16 on said plan;
THENCE Southerly by Lots 16, 15 and 14 on said plan to the point of beginning.
Being Lot 17 on “Plan of House Lots in Auburn, Mass.” Drawn November 1, 1948 and recorded with Worcester District Registry of Deeds, Plan Book 155, Plan 99.
For title see deed recorded with said Worcester District Registry of Deeds on May 28, 2024 in Book 70556, Page 289.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Twenty-Five Thousand and 00/100 Dollars ($25,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
