NOTICE OF SALE UNDER POWER IN SECURITY DEED
STATE OF GEORGIA COUNTY OF CHATHAM
Under and by virtue of the Power of Sale contained in the Deed to Secure Debt dated as of December 12, 2024, from 3126 MONTGOMERY STREET LLC (the “Grantor”) to WESTMOORE LENDING PARTNERS III, LLC (the “Lender”), recorded in Deed Book 3557, page 290, Chatham County Georgia records, (the “Security Deed”) the undersigned will sell at public outcry to the highest and best bidder for cash before the door of the Courthouse of Chatham County, Georgia, during the legal hours of sale, on the first Tuesday in APRIL 2026 (i.e., APRIL 2, 2026), the following described real and personal properties located in Chatham County, Georgia (together, the “Property”), to wit:
Commencing at the Southeastern corner of the intersection of Montgomery Street and Clifford Street, said point being the POINT OF BEGINNING; running thence along the southerly right-of-way of Clifford Street South 67°8'25" East a distance of 126.3 feet to a point on the northern side of a 75 foot right-of-way now or formerly owned by Seaboard Coastline Railroad and proceeding along said right-of-way South 63°8'25" West a distance of 194.01 feet to a point at the intersection of Montgomery Street and said railroad right-of-way and proceeding thence along the southerly side of the Montgomery Street right-of-way North 22°31 '25" East a distance of 147.27 feet to a point, said point being the POINT OF BEGINNING. Said property being more fully set forth on a plat prepared by Leo V. Exley, R.L.S. 2119, on August 4, 1995, on behalf of American Port Services, the same being and hereby is incorporated by reference. Said property is also known as Lots 1 through 5 and a former 12 foot lane, Wright Ward, Savannah, Chatham County, Georgia. Said property being bounded on the North by Clifford Street; on the East and South by the right-of-way of the Seaboard Coastline Railroad; and on the West by Montgomery Street.
This property has a street address of 3126 Montgomery Street, Savannah, Chatham County, Georgia, according to the current system of numbering streets in Chatham County, Georgia; TPIN 20074-48004.
TOGETHER WITH all easements, rights-of-way, strips and gores of land, streets, ways, alleys, passages, sewer rights, waters, water courses, water rights and powers, and all estates, rights, titles, interests, minerals, royalties, easements, privileges, liberties, tenements, hereditaments and appurtenances whatsoever, in any way belonging, relating of appertaining to the Property or any part thereof, or which hereafter shall in any way belong, relate or be appurtenant thereto, whether now owned or hereafter acquired by Borrower and the reversion and reversions, remainder and remainders thereof.
The debt secured by the Security Deed is evidenced by a Note executed by 728 EAST 55TH STREET LLC (“Borrower”) in favor of Lender, dated on or about December 12, 2024 in the original principal amount of $1,300,000.00, and currently held by Lender (the “Note”), plus interest from that date on the unpaid balance until paid.
Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed. By reason of this default, the Security Deed has been declared foreclosable according to its terms. The above-described real property will be sold to the highest and best bidder for cash as the property of Grantor, the proceeds to be applied to the payment of said indebtedness, attorneys' fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed. The sale shall be subject to the following: all outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; any matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and any matters of record superior to the Security Deed.
The sale will be conducted subject (1) to confirmation that the sale is permitted by any applicable court; and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice of this sale has been given to the Grantor pursuant to O.C.G.A. Section 44-14-162 et seq.
To the best of the undersigned's knowledge and belief, the real property is presently owned by 3126 MONTGOMERY STREET LLC. To the best of the undersigned's knowledge and belief, the party in possession of the real property is 3126 MONTGOMERY STREET LLC.
