NOTICE OF SALE UNDER POWER IN SECURITY DEED
STATE OF GEORGIA COUNTY OF CHATHAM
Under and by virtue of the Power of Sale contained in the Deed to Secure Debt dated as of December 12, 2024, from 402 MARTIN LUTHER KING LLC (the “Grantor”) to WESTMOORE LENDING PARTNERS III, LLC (the “Lender”), recorded in Deed Book 3557, page 364, Chatham County Georgia records, (the “Security Deed”) the undersigned will sell at public outcry to the highest and best bidder for cash before the door of the Courthouse of Chatham County, Georgia, during the legal hours of sale, on the first Tuesday in APRIL 2026 (i.e., APRIL 2, 2026), the following described real and personal properties located in Chatham County, Georgia (together, the “Property”), to wit:
All those certain lots, tracts, or parcels of land situate, lying, and being in the City of Savannah, Chatham County, Georgia, known and designated on the map or plan of the City of Savannah as Lot Four (4) and Lot Five (5), Fourth Tything, Reynolds Ward, and being more particularly described upon a map or plat thereof entitled "Plat showing Lots Four (4) and Five (5), Reynolds Ward, located on the Southwest corner of Lincoln and Congress Streets, Savannah, Georgia. Thomas and Hutton Engineering Company, Savannah, Georgia, March 25, 1960" as follows: Beginning at a stake located on the southern boundary line of the right of way of Congress Street 123.64 feet N73°00'W from southeast corner of Congress and Lincoln Streets, and from said point of beginning running along the southern boundary line of Congress Street S73°00'E, a distance of 123.64 feet to a point located at the southwest intersection of the right of ways of Congress and Lincoln Streets; thence, along the western boundary line of Lincoln Street S17°11'W, a distance of 90.0 feet to a point located at the northwest corner of the intersection of Congress Street Lane and Lincoln Street; thence, along the northern boundary line of Congress Street Lane N73°00'W, a distance of 123.74 feet to a stake located on the said northern boundary line of said lane; thence, Nl7°15'E, a distance of 90.0 feet to a stake located on the southern boundary line of the right of way of Congress Street, and which marks the point of beginning. A copy of said plat is recorded in Plat Record Book K, Page 78, in the Office of the Clerk of the Superior Court of Chatham County, Georgia, to which reference is hereby made for a more particular description of the metes and bounds.
Saving and excepting therefrom a 1.2 foot rectangular strip of the western portion of said Lot 4 delineated on a plat thereof by Wright C. Powers, RLS, dated February 10, 1977, recorded in Plat Record Book AA, Page 161, Chatham County records to which reference is hereby made for a more particular description of the metes and bounds.
This property has a street address of 215 East Congress Street, Savannah, Chatham County, Georgia, according to the current system of numbering streets in Chatham County, Georgia; TPIN 20004-40006.
TOGETHER WITH all easements, rights-of-way, strips and gores of land, streets, ways, alleys, passages, sewer rights, waters, water courses, water rights and powers, and all estates, rights, titles, interests, minerals, royalties, easements, privileges, liberties, tenements, hereditaments and appurtenances whatsoever, in any way belonging, relating of appertaining to the Property or any part thereof, or which hereafter shall in any way belong, relate or be appurtenant thereto, whether now owned or hereafter acquired by Borrower and the reversion and reversions, remainder and remainders thereof.
The debt secured by the Security Deed is evidenced by a Note executed by 728 EAST 55TH STREET LLC (“Borrower”) in favor of Lender, dated on or about December 12, 2024 in the original principal amount of $1,300,000.00, and currently held by Lender (the “Note”), plus interest from that date on the unpaid balance until paid.
Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed. By reason of this default, the Security Deed has been declared foreclosable according to its terms. The above-described real property will be sold to the highest and best bidder for cash as the property of Grantor, the proceeds to be applied to the payment of said indebtedness, attorneys' fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed. The sale shall be subject to the following: all outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; any matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and any matters of record superior to the Security Deed.
The sale will be conducted subject (1)to confirmation that the sale is permitted by any applicable court; and (2)to final confirmation and audit of the status of the loan with the holder of the Security Deed.
Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Security Deed. Notice of this sale has been given to the Grantor pursuant to O.C.G.A. Section 44-14-162 et seq.
To the best of the undersigned's knowledge and belief, the real property is presently owned by 402 MARTIN LUTHER KING LLC. To the best of the undersigned's knowledge and belief, the party in possession of the real property is 402 MARTIN LUTHER KING LLC.
