PLEASE TAKE NOTICE that the Planning Board of the City of Paterson (the "Board") will hold a special public hearing on Monday, March 23, 2026 at 6:30 p.m., and thereafter on such dates and times as such hearing may be continued, in the City of Paterson Council Chambers, 155 Market Street, 3rd Floor, Paterson, New Jersey, for the purpose of reviewing and taking action upon the application of McDonald's USA, LLC (the "Applicant"), which seeks minor subdivision approval in order to subdivide the existing 140,100 sq. ft. retail shopping center into the following two lots: (i) proposed parcel B (the "McDonald's Lot") to consist 23,187 sq. ft. which will contain the McDonald's restaurant only; and (ii) proposed parcel A (the "Remining Lot") to consist of 116,913 sq. ft. which will contain the remaining four retail buildings. The property is located at 186-194 Third Avenue and designated as Block 2307, Lot 1 on the Tax Map of the City of Paterson (the "Property"). The Property is located in the I-2 (Heavy Industrial) District.
In connection with the foregoing, the Applicant seeks all variances, waivers, exceptions, interpretations and other relief necessitated by the plans it has currently filed with the Board, together with any additional variances, waivers, exceptions, interpretations and other relief that may be necessitated by changes to the plans requested by the Board, and any and all other relief that the Board may determine to be appropriate or necessary for the project. This relief may include but may not necessarily be limited to: (i) a variance for a lot coverage of 85.03% on the Remaining Lot and 87.32% on the McDonald's Lot where the maximum permitted by Ordinance is 60%; (ii) a variance for 104 parking spaces on the Remaining Lot where the Ordinance requires a minimum of 155 spaces; and (iii) a variance for 18 parking spaces on the McDonald's Lot where the Ordinance requires a minimum of 98 spaces. In addition, the following pre-existing non-conforming condition is proposed to continue: a front yard setback of 7.5 ft. on the Remaining Lot where the Ordinance requires a minimum of 10 ft.
Any person or persons affected by this application may attend the hearing, personally, or by agent or attorney, and present any objections which they may have or otherwise be heard regarding this application. Members of the public may also inspect the plans, reports, application and supporting materials on file at the office of the Division of Planning & Zoning, 125 Ellison Street, 4th Floor, Paterson New Jersey, during normal business hours.
