NOTICE OF DECISION TOWNSHIP OF BRICK PLANNING BOARD OCEAN COUNTY, NEW JERSEY TAKE NOTICE that at a regular meeting on February 25, 2026, the Planning Board ("Board") of the Township of Brick adopted a Resolution memorializing the action taken on February 11, 2026, granting the Applicant, M&M at Route 70, LLC an Amended Preliminary and Final Major Site Plan, which approval continued to include variances that were previously granted, as well as the additional variances referenced herein, to permit and substitute a 2,426 square foot Habit Burger Fast Food Restaurant with a mobile pick-up lane, along with related site improvements on the property for a previously approved 6,400 square foot commercial building, located at 770-778 Route 70, Township of Brick, Ocean County, New Jersey, and designated on the Township of Brick Tax Maps as Block 702, Lots 30.01 and 30.02, consisting of approximately 10.9 acres, in the B-3 (Highway Development) Zone and the Metedeconk Village Redevelopment Zone ("Property"). The Board granted the following variances for the Amended Application: 1)Section 245-10 permits a maximum impervious coverage of 80%, whereas the 87.1% previously approved by the Board was reduced to 86.7%. 2)Section 245-311.G. requires commercial truck loading and unloading areas provided in sufficient amount to permit the transfer of goods and products in other than a public street or public parking area and shall be located separately from such area, whereas no loading zone was proposed in the Amended Application and was granted. 3)Section 245-313.A.12 permits any combination of signs to be erected on three (3) sides of a building fronting on more than one public or private thoroughfare, driveway or parking area, whereas four (4) façade signs were granted.
