PUBLIC NOTICE
DELAWARE WATER GAP ZONING HEARING BOARD
TAKE NOTICE that the Delaware Water Gap Zoning Hearing Board shall convene a Public Hearing at the Delaware Water Gap Municipal Building, located at 49 Main Street, Delaware Water Gap, Monroe County, Pennsylvania on Wednesday, March 25, 2026, commencing at 6:00 P.M. The Zoning Hearing Board shall consider the Application for a Public Hearing submitted by Milton Lema, owner of a vacant lot bearing Tax ID # 04.94744, Monroe County Map #: 04731000693431, located on Foxtown Hill Road in the Borough of Delaware Water Gap. The property is located in the VC-1 zoning district. The Application is in response to an Enforcement Notice issued on January 2, 2026, by the Borough Zoning Officer directing Mr. Lema to cease and desist using the subject lot as a bus, limousine or taxi terminal, which is prohibited in the VC-1 zone. The Application is an Appeal of the Zoning Officer’s Decision, a request for a Variance, Interpretation and a Substantive Validity Challenge to the Zoning Ordinance provisions addressing the use of the property. Mr. Lema asserts that his use of the subject property is for a private parking area, which is permitted in the VC-1 zone. The hearing process will be conducted in accordance with Delaware Water Gap Zoning Ordinance Article XII section 173(B),174 and 175 et. seq. and 53 P.S. 10908. This matter was originally scheduled for a hearing set to occur on February 25, 2026. That hearing was cancelled and continued to the new hearing date. The Application shall be available for inspection upon request by any interested persons at the Delaware Water Gap Municipal Building during normal business hours. All persons who have an interest in the Application are invited to attend the hearing and persons with legal standing are invited to provide testimony and evidence with respect to the Application. Any person having any special need of accessibility is encouraged to contact the Borough Secretary in advance of the hearing to make reasonable accommodations.
