By virtue and in execution of the Power of Sale contained in a certain mortgage given by Debra Bittle and Arthaniel Bittle Sr and Lucille Bittle to Washington Mutual Bank, FA, and now held by U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust, said mortgage dated September 23, 2005 and recorded in the Plymouth County Registry of Deeds in Book 31436, Page 66, as affected by a Loan Modification dated March 4, 2016 and recorded in the Plymouth County Registry of Deeds in Book 46788, Page 94; as affected by a Loan Modification dated June 7, 2018 and recorded in the Plymouth County Registry of Deeds in Book 52077, Page 170; as affected by a Loan Modification dated June 8, 2021 and recorded in the Plymouth County Registry of Deeds in Book 56115, Page 327; said mortgage was assigned from Federal Deposit Insurance Corporation, as receiver of Washington Mutual Bank f/k/a Washington Mutual Bank, FA to JPMorgan Chase Bank, National Association by assignment dated May 28, 2013 and recorded with said Registry of Deeds in Book 43139, Page 41; said mortgage was assigned from JPMorgan Chase Bank, National Association to Pretium Mortgage Credit Partners I Loan Acquisition, LP by assignment dated January 22, 2016 and recorded with said Registry of Deeds in Book 46638, Page 196; said mortgage was assigned from Pretium Mortgage Credit Partners I Loan Acquisition, LP to Wilmington Savings Fund Society, FSB d/b/a Christiana Trust, not individually but as trustee for Pretium Mortgage Acquisition Trust by assignment dated February 1, 2016 and recorded with said Registry of Deeds in Book 46638, Page 199; said mortgage was assigned from Wilmington Savings Fund Society, FSB d/b/a Christiana Trust, not individually but as trustee for Pretium Mortgage Acquisition Trust to J.P. Morgan Mortgage Acquisition Corp by assignment dated March 30, 2022 and recorded with said Registry of Deeds in Book 56693, Page 161; said mortgage was assigned from J.P. Morgan Mortgage Acquisition Corp to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust by assignment dated February 27, 2025 and recorded with said Registry of Deeds in Book 59763, Page 173; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 9, 2026 at 02:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
All that certain parcel of land situate in the Town of Brockton, County of Plymouth and State of Massachusetts, known and designated as being at the junction of Highland Terrace, formerly known as Highland Street, and Spring Street, bounded and described as follows:
BEGINNING on the west side of said Highland Terrace at a stake at the southeast corner of land now or formerly of one Nelson;
Thence running southerly along said Highland Terrace, forty-nine and ninety-five hundredths (49.95) feet to a point;
Thence by a curved line at the intersection of said Highland Terrace and Spring Street, fifteen and seventy-one hundredths (15.71) feet to a point in said Spring Street;
Thence westerly by said Spring Street, ninety-nine (99) feet to land now or formerly of one Olmstead;
Thence running northerly, fifty-seven and fifty-five hundredths (57.55) feet by land of Olmstead; to a stake at land of said Nelson;
Thence running easterly by said land of Nelson, one hundred one and six tenths (101.60) feet to the point of beginning.
Being lot numbered thirty-six (36) as shown on a plan of Highland Terrace, Brockton, Mass., owned by John V. Scott and C.C. Barton and duly filed at Plymouth County Registry of Deeds. Said premises are conveyed subject to restrictions of record so far as now in force and applicable.
Being the same property as conveyed from George J. Roberts, III, Trustee of GJ&K Triangle Trust, under Declaration of Trust, dated November 29, 1994, recorded at Plymouth County Registry of Deeds, Book 13387, Page 263 to Debra Bittle and Arthaniel Bittle, Sr ., as joint tenants with the right of survivorship, as described in Deed Book 14143, Page 306, Dated 02/15/1996, Recorded 02/16/1996 in PLYMOUTH County Records.
Subject to Taking by the City of Brockton for the layout of street as a public was as set forth in Book 19886 Page 121, Recorded 05/24/2001, in PLYMOUTH County Records.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated February 15, 1996 and recorded in the Plymouth County Registry of Deeds in Book 14143, Page 306.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
