NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Apol-lo Auto Brokers, LLC, mortgagor, to Capital Funding Financial, LLC, as mortgagee, dated July 29, 2024 and recorded July 30, 2024 as Doc # 1,539, 492, Ctf # 211938, then assigned to Patten Family Finance, LLC by assignment recorded September 11, 2024 as Doc # 1,541, 414, Ctf # 211938, then assigned to Allison Lending LLC by assignment recorded December 1, 2025 as Doc # 1,562, 724, Ctf #211938, all in the Norfolk County Land Court, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the pur-pose of foreclosing, the same will be sold at Public Auction at 1 O’Clock P.M. on the 10th day of April, 2026 at 26 Genevieve Road, Weymouth, Norfolk County, Massachusetts, all and singular the premises described in said mortgage, to wit:
The land in Weymouth, County of Norfolk, Massachusetts, bounded and described as follows:
NORTHWESTERLY by James Road, shown on the plan hereinafter referred to, fifty-three and 80/100 (53.80) feet; NORTHERLY by the junction of said James Road and Genevieve Road, shown on said plan, fifty-five and 54/100 (55.54) feet; NORTHEASTERLY by said Genevieve Road, seventy-five and 50/100 (75.50) feet; SOUTHEASTERLY by lot numbered 18, shown on said plan, ninety (90) feet; and SOUTHWESTERLY by lot numbered 21, shown on said plan, eighty-nine and 44/100 (89.44) feet.
Said parcel is shown as Lots numbered 19 and 20 on a plan drawn by Russell H. Whiting, Civil Engineer, dated September 15, 1924, as approved by the Land Court, filed in the Land Registra-tion Office as No. 10412A, a copy of a portion of which is filed in Norfolk Registry District with Certificate No. 7970, Book 40.
Premises to be sold as-is and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, building and zoning laws, any and all unpaid taxes, tax titles, tax liens, wa-ter and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed, rights of tenants or parties in possession, and attorney’s fees and costs.
Terms of sale: A deposit of ten thousand dollars ($10,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. Deposit to be increased to ten percent (10%) of the purchase price within five (5) business days of the auction sale. The suc-cessful bidder will be required to execute a sale agreement immediately after the close of bid-ding. The balance, plus a five percent (5%) buyer’s premium to the auction company, is to be paid to the Mortgagee’s attorney by certified or bank check or other check satisfactory to Mort-gagee’s attorney within thirty (30) days from the date of sale. Deed will be provided to purchas-er for recording upon receipt in full of the purchase price and buyer’s premium. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, except upon a default by the purchaser, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no fur-ther recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. TIME WILL BE OF THE ESSENCE. In the event of an error in this publication, the description of the prem-ises contained in said mortgage shall control. Other terms, if any, to be announced at the sale.
