PUBLIC NOTICE
Pursuant to the “Surface Mining Conservation & Reclamation Act” and “Clean Streams Law” notice hereby is given that J & J Svonavec Excavating, Inc., 555 Philadelphia St, Indiana, PA 15701 has made application to the Pennsylvania Department of Environmental Protection to conduct surface mining activities within 100’ of an unnamed tributary to the North Branch of Jennings Run on SMP No.56920114, Bonding Increment 03, NPDES No. PA02112334. The variance request is located on the lands of Kevin M. Seidl and will consist of the use and upgrade of an existing private roadway and stream crossing. The crossing is located approximately 3500 feet upstream of the Unnamed Tributary’s Confluence with North Branch of Jennings Run. It will include approximately 50 feet of stream length and approximately 0.12 acres within 100 feet.
The operation is located in Southampton Township, Somerset County, and is known as Mellott Strip. The permit area is 278.5 acres situated approx. 1.9 miles west of the village of Wellersburg along Township Route 309. The receiving stream for the permit area is unnamed tributaries to North Branch of Jennings Run, Jennings Run, and unnamed tributaries to Jennings Run, all cold water fisheries. The Frostburg, MD-PA 7.5' U.S.G.S topographic map contains the area described 18.5 inches north and 1.5 inches west of the bottom right hand corner of the printed area of the map.
A copy of the application is available for public inspection at the Department of Environmental Protection, Cambria Office, Bureau of District Mining Operations, 286 Industrial Park Rd., Ebensburg, PA 15931-4119. Written comments, objections, or a request for public hearing or informal conference may be submitted to the District Mining Manager at the above address no later than thirty (30) days following the final publication date of this notice. Any correspondence must include the person's name, address, telephone number, and a brief statement as to the nature of the objection.
