TO: The Estate of Duverney B. Matlack
The United States of America (“United States”), on behalf of the United States Environmental Protection Agency (“EPA”), has filed a civil lawsuit against the Estate of Duverney B. Matlack under Section 104(e) of the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. § 9604(e), to access the parcel of real property (the “Property”) located at 2160 US 322 and identified as Block 6, Lot 5 on the Woolwich Township, Gloucester County, New Jersey tax map, to begin remedial work on the Matlack, Inc. Superfund Site. EPA has determined that the Estate of Duverney B. Matlack has an ownership interest in the Property and has been unable to identify a personal representative and obtain consent to access the Property. Through this action, the United States seeks an order providing EPA and its designated representatives with a right of access to the Property for the purpose of conducting additional soil sampling as needed, installing treatment equipment, excavating contaminated soil, disposing of the contaminated soil off-site, and conducting long-term monitoring.

If you dispute this lawsuit, you or your attorney must file a written answer or motion and proof of service on or before twenty-one (21) days after the third publication of this Notice of Publication with the United States District Court, District of New Jersey under Rule 12 of the Federal Rules of Civil Procedure, in accordance with the rules governing the courts. You must also send a copy of your answer or motion to plaintiff’s attorney at the following address:
