The following parties, namely: Unknown Transferees, Assigns, Executors, Administrators, Devisees and Heirs of Edgar W. Geiser, Deceased, and all persons claiming by, through, or under them, Addresses Unknown, will take notice that they have been named as defendants by Plaintiff Pamela Boratyn, Director of the Ohio Department of Transportation, who instituted Case No. 2026 CVC-H 000029 now pending in the Common Pleas of Wayne County, Ohio, which is an action to appropriate certain property for highway purposes, namely the making, constructing, repairing or improving of State Route 94, Section 18.21, Wayne County, and to fix the value of said property.
The property sought to be appropriated is more specifically described as follows on the following 2 pages:

PERPETUAL EASEMENT FOR HIGHWAY PURPOSES WITHOUT LIMITATION OF EXISTING ACCESS RIGHTS
An exclusive perpetual easement for public highway and road purposes, including, but not limited to any utility construction, relocation and/or utility maintenance work deemed appropriate by the State of Ohio, Department of Transportation, its successors and assigns forever.
Grantor/Owner, for himself and his heirs, executors, administrators, successors and assigns, reserves all existing rights of ingress and egress to and from any residual area (as used herein, the expression “Grantor/Owner” includes the plural, and words in the masculine include the feminine or neuter).
Situated in the State of Ohio, County of Wayne, Township of Chippewa, and being a part of Section 19, Township 18 North, Range 11 West, being part of a 5.222 acre parcel conveyed to EDGAR W. GEISER, by Deed Volume 475, Page 17, and being more particularly described below:
Being a parcel of land lying right of the Centerline of Right of Way of State Route 604, as found on WAY-94-18.21 made by Mead & Hunt, for the Ohio Department of Transportation as recorded in Plat Book 34, Page 142 in the records of Wayne County, and being located within the following described boundary points in the boundary thereof:
Commencing from the northeastern corner of Section 19, said corner also being the northwestern corner of Section 20, said corner also being the southeastern corner of Section 18, said corner also being the southwestern corner of Section 17, said corner being referenced by a concrete
monument found bearing South 89 Degrees 41 Minutes 50 Seconds West at a distance of 30.04 feet, said corner also being referenced by a concrete monument found bearing North 00 Degrees 48 Minutes 54 Seconds West at a distance of 60.10 feet;
Thence South 00 Degrees 48 Minutes 54 Seconds East along the easterly line of Section 19, said line also being the westerly line of Section 20, a distance of 118.88 feet to the intersection of said section line and the Centerline of Right of Way of State Route 585, also known as Akron Rd, said point also being Station 829+20.93 of the Centerline of Right of Way of State Route 585;
Thence South 26 Degrees 55 Minutes 55 Seconds West along the Centerline of Right of Way of State Route 585, a distance of 235.93 feet to a monument box found at the intersection of the Centerline of Right of Way of State Route 585 and the Centerline of Right of Way of State Route 604, also known as Easton Rd and the Centerline of Right of Way of State Route 94, also known as Mt. Eaton Rd, said box also being replaced by a concrete monument set at Station 826+85.00 of the Centerline of Right of Way of State Route 585, said monument also being Station 961+48.80 of the Centerline of Right of Way of State Route 604;
Thence North 63 Degrees 16 Minutes 57 Seconds West along the Centerline of Right of Way of State Route 604, a distance of 320.40 feet to the westerly line of the Grantor, said line also being the easterly line of a 0.800 acre parcel conveyed to DEBORAH A. MEADOWS, by Deed Volume 384, Page 2495, being Station 958+28.40 of the Centerline of Right of Way of State Route 604;
Thence South 09 Degrees 08 Minutes 17 Seconds West along the westerly line of the Grantor, said line also being the easterly line of said parcel conveyed to Deborah A. Meadows, a distance of 47.12 feet to the existing southerly Right of Way line of State Route 604, being 44.92 feet right of Station 958+42.63 of the Centerline of Right of Way of State Route 604, said point marking the Principle Point of Beginning for the parcel described herein;
1. Thence South 63 Degrees 19 Minutes 56 Seconds East along the southerly Right of Way line of State Route 604, a distance of 192.11 feet to 44.75 feet right of Station 960+34.74 of the Centerline of Right of Way of State Route 604;
2. Thence South 19 Degrees 09 Minutes 48 Seconds East along the southerly Right of Way line of State Route 604, a distance of 57.44 feet to 84.74 feet right of Station 960+75.98 of the Centerline of Right of Way of State Route 604, said point also being 72.50 feet left of Station 825+99.99 of the Centerline of Right of Way of State Route 585;
3. Thence South 23 Degrees 21 Minutes 45 Seconds West along the westerly Right of Way line of State Route 585, a distance of 125.23 feet to an iron pin set, being 64.71 feet left of Station 824+75.00 of the Centerline of Right of Way of State Route 585;
4. Thence North 02 Degrees 48 Minutes 49 Seconds East, a distance of 98.61 feet to an iron pin set, being 105.00 feet left of Station 825+65.00 of the Centerline of Right of Way of State Route 585;
5. Thence North 26 Degrees 37 Minutes 01 Seconds West, a distance of 91.45 feet to an iron pin set, being 178.56 feet left of Station 826+19.33 of the Centerline of Right of Way of State Route 585, said pin also being 65.00 feet right of Station 959+70.00 of the Centerline of Right of Way of State Route 604;
6. Thence North 63 Degrees 16 Minutes 57 Seconds West parallel to the Centerline of Right of Way line of State Route 604, a distance of 121.00 feet to an iron pin set on the westerly line of the grantor, said line also being the easterly line of said parcel conveyed to Deborah A. Meadows, said pin being 65.00 feet right of Station 958+49.00 of the Centerline of Right of Way of State Route 604;
7. Thence North 09 Degrees 08 Minutes 17 Seconds East along the westerly line of the Grantor, said line also being the easterly line of said parcel conveyed to Deborah A. Meadows, a distance of 21.06 feet to the Principle Point of Beginning and enclosing 0.211 acres, more or less of which the present road occupies 0.000 acres, resulting in a net take of 0.211 acres.
The above described area is all within Wayne County Permanent Parcel Number 12-02608.000;
The iron pins set are 3/4 inch diameter x 30 inch long rebar with a 2 inch diameter aluminum cap marked ODOT R/W Mead & Hunt, Inc. 8294. Monument Boxes Set are 1 inch steel rods with a 3 inch aluminum cap set encased in a monument box assembly. Concrete Monuments Set are 3/4 inch iron pins encased in an 8 inch diameter concrete cylinder with a 3 inch diameter aluminum cap. Both the Monument Box Set and Concrete Monuments Set (Reference Monument) are detailed by ODOT standard construction drawing RM-1.1, dated 1-20-23. These monument boxes and concrete monuments are set by the highway contractor under the direction of a Professional Surveyor.
Bearings are relative to Grid North of Wayne County of the Ohio County Coordinate System (LDP). The Values were based on control set in June, 2023 using the Ohio VRS projection set: Ohio North NAD 83(2011) Datum. Bearings are for the purpose of indicating angular measurement only.
Pursuant to Ohio Civil Rule 12(A)(1), said persons mentioned above shall take further notice that they have days after the completion of the Service by Publication within which to answer or otherwise defend against Plaintiffs petition.
The original of any such answer or other defense against Plaintiff s petition must be filed with the Clerk of the Common Pleas of Wayne County, Ohio, whose office is located at 215 N Grant Street, Wooster, OH, 44691. A copy of any such answer or other defense against Plaintiffs
petition must be served upon Plaintiffs attorney, namely: Nicole Steiner Deas, Assistant Attorney General, at 30 East Broad Street, 26th Floor, Columbus, Ohio
43215-3167.
Failure to answer or otherwise defend against Plaintiff s petition within said days will result in Plaintiff, pursuant to Civil Rule 55, asking the court to grant a judgment by default against any such person who fails to answer or otherwise defend.
