Final Notice and Public Explanation of a Proposed Activity in a Wetland
To: All interested Agencies, Groups and Individuals
This is to give notice that the Virginia Department of Housing and Community Development (DHCD), under 24 CFR Part 58 has conducted an evaluation as required by Executive Order 11990, and in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the HOME Investment Partnership Program. The proposed project is located at 230 Medical Park Boulevard in the City of Petersburg, Virginia and the proposed activities include a multi-family apartment complex. The project is proposed to impact 0.10 acres of palustrine forested wetland for the construction of a stormwater utility infrastructure to service the development. DHCD has determined that existing functions and values, such as providing flood control, prevention of pollution, recreation, aesthetic appreciation, erosion control, and groundwater recharge, would not be negatively impacted.
DHCD has reevaluated the proposed project and the no-build alternative. As a result, it has been determined that there is no practicable alternative to the proposal to meet the goal of the project. The basis for this determination is as follows: 1) site plans have been designed to minimize the effects to the wetlands, 2) the proposal is in compliance with the City's Planning and Zoning requirements, 3) no comparable sites are available for development, 4) the project has obtained a permit authorization (NAO-2025-00275) from the U.S. Army Corps of Engineers (USACE) and the Virgina Department of Environmental Quality (DEQ), and 5) compensatory mitigation will be utilized.
There are three primary purposes for this notice. First, people who may be affected by activities in wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetlands, it must inform those who may be put at greater or continued risk.
Written comments must be received by the DHCD at the following address on or before March 27, 2026: Virginia Department of Housing and Community Development, 600 East Main Street Suite 300, and 804-371-7000, Attention: Carly Lackman, Rental Housing Program Manager.
