LEGAL NOTICE
Notice is hereby given that the Board of Trustees of Union Township, Clermont County, Ohio adopted Resolution No. 2026-18 on March 10, 2026, designating authority regarding the declaration of a snow emergency authorization within Union Township pursuant Ohio Revised Code Section 505.17. Pursuant to Ohio Revised Code, the entirety of the text of adopted Resolution 2026-18 shall be published for three (3) weeks prior to becoming effective. The entire text of Resolution 2026-18, as adopted on March 10, 2026, is provided below:

RESOLUTION DESIGNATING AUTHORITY REGARDING THE DECLARATION OF A SNOW EMERGENCY AUTHORIZATION WITHIN UNION TOWNSHIP PURSUANT TO OHIO REVISED CODE SECTION 505.17

The Board of Trustees of Union Township, Clermont County, Ohio met in regular session at the Union Township Administration Building, 4350 Aicholtz Road, Cincinnati, OH 45245 on March 10, 2026 with the following members present: Joe Dills, John Becker, and Michael Logue.
Mr. Becker made a motion to adopt the following Resolution: 2026-18
WHEREAS, Ohio Revised Code (“ORC”) Section 505.17(A) provides the Board of Trustees of Union Township, Clermont County, Ohio (the “Board”) with the authority to make regulations and orders as are necessary to control all vehicle parking within the unincorporated areas of the Township; and
WHEREAS, ORC 505.17(A) provides the Board with the authority to adopt a general snow emergency authorization (“snow emergency”), allowing the President of the Board, or some other person or agent as designated by the Board herein, to issue an order declaring a snow emergency, and limiting or prohibiting parking on any Township street or road during the snow emergency; and
WHEREAS, ORC Section 505.17(A) further provides that any snow emergency authorization shall specify the weather conditions under which a snow emergency may be declared; and
WHEREAS, ORC Section 505.17(E) provides that any person who violates a regulation adopted in accordance with ORC 505.17(A) is guilty of a minor misdemeanor; and
WHEREAS, ORC Section 505.17(D) further provides that the Board, or its designated agent, with the authority to order into storage any vehicle found to be parked in violation of a regulation or order adopted in accordance with ORC Section 505.17(A); and
WHEREAS, the Board has determined that the decision to declare a snow emergency authorization in the Township is in the best interest of public safety and welfare, and must be made in a time-sensitive manner, based upon current, projected, and evolving weather conditions, which are subject to rapid change or deviation from forecasted projections and therefore precludes the opportunity to properly notice and convene a Special Meeting of the Board of Trustees to consider such a declaration, consistent with the Ohio Open Meetings Act specified in ORC Section 121.22.
NOW, THEREFORE BE IT RESOLVED, by the Board of Trustees of Union Township, Clermont County, Ohio, pursuant to the authority granted within Section 505.17 of the Ohio Revised Code, as follows:
SECTION 1. The Board hereby authorizes the President of the Board to issue an order declaring a snow emergency and limiting or prohibiting parking on any Township street or road.
SECTION 2. The Board further authorizes the Township Administrator, after conferring jointly with the Service Director, Police Chief, and Fire Chief, to declare a snow emergency in the Township when the President of the Board is unavailable, or in such instances where in the opinion of the Township Administrator, road and weather conditions warrant such a declaration being made, as to allow for the efficient removal of snow and ice to occur along all streets and roads within the Township.
SECTION 3. The Board further establishes that the weather conditions under which a snow emergency may be declared, as are follows:
Union Township Snow Emergency Classifications:
Level 1 Snow Emergency: Roadways are hazardous with blowing and drifting snow. Road conditions may also include ice proliferation or slippery conditions. Motorists are urged to drive cautiously. Parking along Township streets or roads shall be prohibited.
Level 2 Snow Emergency: Roadways are extremely hazardous with blowing and drifting snow. Road conditions are extremely slippery and significant accumulations of snow and ice present. Driving shall be limited to necessary trips only, and residents should contact their employer to determine if they are to report for work. Motorists are urged to use extreme caution if driving. Parking along Township streets or roads shall be prohibited.
Level 3 Snow Emergency: All Township roads and streets are closed to non-emergency/non-essential personnel due to extremely hazardous roadway and/or weather conditions with significant accumulations of snow and/or ice rendering roads impassable. Driving shall be strictly prohibited during a Level 3 Snow Emergency barring exigent circumstances, which may include, but not be limited to the following exceptions: emergency operations personnel and or essential services personnel traveling to or from their residence or place of employment, Township personnel traveling in the performance of their appointed duties, and/or persons traveling to or from a documented personal emergency. All residents should contact their employer and determine if they are required to report for work. All other travel along Township roads or streets shall be strictly prohibited, and persons found in violation may be subject to additional criminal citations and/or may be subject to arrest. Parking along all Township streets or roads shall be strictly prohibited.
SECTION 4. The Board hereby declares, via adoption of this Resolution, that parking shall be regulated on all Township streets or roads during a snow emergency declared by the Township.
SECTION 5. Parking shall be strictly prohibited along all Township roads, streets, and/or roadway rights-of-way during a Level 1 Snow Emergency or greater. Any person found to have parked a vehicle along any Township road or street in violation of this Resolution during a declared Snow Emergency in Union Township is guilty of a minor misdemeanor.
SECTION 6. Pursuant to ORC Section 505.17(B)(2), an order issuing a Snow Emergency in Union Township shall become effective two (2) hours after such announcement is made to the local news media.
SECTION 7. In addition to criminal penalties as specified in Section 5 of this Resolution, the Board hereby authorizes the Township Administrator, working in consultation with the Police Chief and Township Service Director, to order into storage any vehicle found to be parked in violation of this Resolution during a declared Snow Emergency. The owner or any lienholder of a vehicle ordered into storage may claim the vehicle upon presentation of proof of ownership, which may be evidenced by a certificate of title to the vehicle, and payment of all expenses, charges, and fines incurred as a result of the parking violation and removal and storage of the vehicle.
SECTION 8. The Board further finds that all fines and fees levied and collected during the course of enforcing this Resolution shall be paid into the Township General Fund.
SECTION 9. A Snow Emergency declared within Union Township shall remain in effect for a continuing period of time, and until such time that it is cancelled by the Township Administrator via issuance of an official notice to the local news media cancelling or otherwise expiring the declared Snow Emergency.
SECTION 10. That, pursuant to the requirements of ORC Section 505.17(B)(1), the Township Fiscal Officer and/or Township Administrator are hereby authorized and directed to post a copy of this Resolution in five (5) conspicuous places within the Township for not less than thirty (30) days before the effective date of this Resolution, in addition to publishing, or causing the publication of the entire text of this Resolution for three (3) consecutive weeks within the Cincinnati Enquirer, a newspaper of general circulation within the Township, and upon the Township website.
SECTION 11. This Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 12. That this Board upon majority vote does hereby dispense with the requirement that this resolution be read on two separate days, and hereby authorizes the adoption of this resolution upon its first reading.
SECTION 13. That this resolution is the subject of the general authority granted to the Board of Trustees through the Ohio Revised Code and not the specific authority granted to the Board of Trustees through the status as a Limited Home Rule Township.
SECTION 14. That this Resolution shall take effect from and after the earliest date as permitted by law, and as per the requirements established within ORC Section 505.17, inclusive.
SECTION 15. That this Resolution shall remain in effect for a continuing period of time, and until such time that it is repealed by a majority vote of the Board of Trustees of Union Township, Clermont County, Ohio.
