NOTICE is hereby given that Plaintiffs, Anthony James Alfano and Danielle Alfano, have filed a Complaint in the Superior Court of New Jersey, Law Division, Monmouth County, seeking to quiet title and obtain a declaration of ownership by adverse possession pursuant to N.J.S.A. 2A:62-1 et seq. and N.J.S.A. 2A:14-30.
The action concerns two 25-foot-wide strips of land adjoining Plaintiffs’ property located at 15 Suffolk Lane, Middletown Township, Monmouth County, New Jersey, designated on the official Middletown Township Tax Map as Block 599, Lot 13 (the “Alfano Property”). The strips are referred to in the Complaint as “Disputed Strip 1” and “Disputed Strip 2.”
Disputed Strip 1 is a portion of land originally owned by Abe Adler and Anna Adler, which was intended to be conveyed pursuant to a written agreement dated September 21, 1959, recorded in the Monmouth County Clerk’s Office in Book 2945 at Page 233, but which was never conveyed out of the Adler chain of title.
Disputed Strip 2 is a separate 25-foot-wide strip that was later included within commercial conveyances associated with property now owned by JAM Realty 33, LLC, whose property is commonly known as 1843 Highway 35, Middletown Township, New Jersey, designated as Block 599, Lot 9 on the Middletown Township Tax Map.
Plaintiffs allege that they and their predecessors in title have openly, notoriously, continuously, exclusively, and hostilely possessed the disputed strips of land for a period exceeding thirty (30) years, that the strips have been fenced, maintained, landscaped, and used as part of the Alfano Property, and that Plaintiffs have thereby acquired title to the property by adverse possession.
The purpose of this action is to obtain a judgment declaring Plaintiffs to be the lawful owners of the disputed strips of land, to quiet title in their favor, and to bar and foreclose any claims of right, title, or interest by Defendants or any other persons claiming an interest therein.
By Order of the Superior Court of New Jersey entered March 13, 2026, Plaintiffs were authorized to effect substituted service upon Defendant JAM Realty 33, LLC by publication of this Notice once per week for two (2) consecutive weeks in a newspaper of general circulation in Monmouth County.
Defendant JAM Realty 33, LLC is required to file and serve an Answer to the Complaint within thirty-five (35) days after the date of the last publication of this Notice, or judgment by default may be entered against it for the relief demanded in the Complaint.
