NOTICE PURSUANT TO NEW YORK EMINENT DOMAIN PROCEDURE LAW REGARDING THE ACQUISITION BY EMINENT DOMAIN OF THE REAL PROPERTY INTERESTS LOCATED AT 31, 37, 33, 41, & 29 W. STATE STREET, CITY OF BINGHAMTON, BROOME COUNTY, NEW YORK
NOTICE IS HEREBY GIVEN, that the City of Binghamton, New York, pursuant to and in accordance with Section 502 of the New York Eminent Domain Procedure Law ("EDPL"), as well as pursuant to the Stipulated Vesting Order of the New York State Supreme Court, Broome County (Hon. Oliver N. Blaise, III, J.S.C.) dated February 25, 2026 and entered in the Broome County Clerk's Office on February 26, 2026 under Broome County Supreme Court Index No. EFCA2025-003112, has acquired fee simple title in and to the parcels of real property located at 31, 37, 33, 41, and 29 W. State Street, in the City of Binghamton, Broome County, State of New York, and identifiable by Tax Map ID Numbers 144.74-1-19, 144.66-1-17, 144.74-1-1, 144.74-1-7, & 144.74-1-8, respectively, more particularly shown on Part 1 of the Acquisition Map recorded in the Broome County Clerk's Office on March 12, 2026 at Liber 2820 of Deeds, page 310 (the "Acquisition Map"), and as more particularly described in Part 2 of said Acquisition Map, together with all of the improvements, parking fields, pedestrian walkways, and drive lanes situated thereon, subject only to easements of record in the Broome County Clerk's Office as specifically shown on Part 1 of the Acquisition Map (Sheet B2), and otherwise free and clear of all other encumbrances, if any, including but not limited to liens, mortgages, leasehold interests, tenancies, and/or rights of first refusal (herein collectively, the "Property"), said Property being the site of the former shopping center known as the "Binghamton Plaza".
NOTICE IS HEREBY FURTHER GIVEN that any written claim for damages or notice of appearance that any condemnee may wish to file pursuant to Section 503 of the EDPL, must be filed with the Clerk of the Supreme Court of Broome County on or before December 31, 2026 and a copy of same shall be served upon: HARRIS BEACH MURTHA CULLINA PLLC, ATTN: Allison B. Fiut, Esq., 726 Exchange Street, Suite 900, Buffalo, New York 14210, as counsel for the City of Binghamton.
NOTICE IS HEREBY FURTHER GIVEN, that all or a portion of the Property acquired is subject to an Environmental Easement held by the New York State Department of Environmental Conservation pursuant to Title 36 of Article 71 of the New York Environmental Conservation Law dated November 19, 2014 and filed in the Broome County Clerk's Office on December 2, 2014 in Liber 2499 of Deeds, page 136. County: Broome; Site No.: C704049; Brownfield Cleanup Agreement Index B7-0702-05-08, as amended.
