NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 685 Oak Street, Unit 26-6 a/k/a Building 26, Unit 6, Madrid Square Condominium, Brockton, MA 02301
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Troy Younger and Tina Younger to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Stearns Lending, LLC, and now held by Lakeview Loan Servicing, LLC, said mortgage dated March 9, 2018 and recorded in the Plymouth County Registry of Deeds in Book 49572, Page 273, as affected by a Loan Modification dated September 11, 2024 and recorded in the Plymouth County Registry of Deeds in Book 59336, Page 96; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Stearns Lending, LLC to Lakeview Loan Servicing, LLC by assignment dated February 21, 2019 and recorded with said Registry of Deeds in Book 50887, Page 324; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 16, 2026 at 04:00 PM Local Time upon the premises, directly in front of the building in which the unit is located, all and singular the premises described in said mortgage, to wit:
The unit known as 26-6 located in Building 26, Unit 6 in Madrid Square Condominium, located at 685 Oak Street, Brockton, Plymouth County, Massachusetts, a Condominium established pursuant to Massachusetts General Laws, Chapter 183A, by Master Deed dated December 23, 1985 and recorded on December 26, 1985 with Plymouth County Registry of Deeds in Book 6496, Page 177, which Unit is shown on the floor plans filed simultaneously with said Master Deed.
The Unit is conveyed together with:
An undivided .0026 percent interest in the common areas and facilities of the Condominium.
An easement for the continuance of all encroachments by the Unit on any adjoining Units or Common Elements now existing or which may come into existence hereafter as a result of settling or shifting of the buildings, or as a result of repair or restoration of the buildings or of the Unit after damage by fire or other casualty, or by reason of alteration or repair to the Common Elements, all as set forth in said Master Deed.
An easement in common with the owners of other Units to use any pipes, wires, ducts, flues, conduits, public utility lines and other Common Elements located in any of the other Units or elsewhere on the Condominium property, and serving the Unit, all as set forth in said Master Deed.
An exclusive right to use one undesignated surface parking space for the purpose of parking one (only) private passenger car, subject to such rules and regulations as the Trustees of the Condominium may from time to time adopt (such Trustees may also from time to time designate and assign Specific parking spaces to Units in the Condominium) and an exclusive right to use the individual storage area located outside the Unit as is assigned to the Unit by such Trustees, subject also to such rules and regulations as the Trustees may from time to time adopt.
The Unit is conveyed subject to:
Easement in favor of adjoining Units and in favor of the Common Elements for the continuance of all encroachments of such adjoining Units or Common Elements on the Unit, now existing or which may come into existence hereafter as a result of settling or shifting of the building, or as a result of repair or restoration of the buildings or of any adjoining Unit or of the Common Elements after damage by fire or other casualty, or after a taking in condemnation or eminent domain proceedings, or by reason of an alteration or repair to the Common Elements made as provided in the Master Deed.
Easements in favor of the other Units to use the pipes, wires, ducts, flues, conduits, public utility lines and other Common Elements located in the Unit and serving such other Units.
The provisions of Chapter 183A, the Master Deed (including, without limitation, all matters set forth on Schedule A thereto), and floor plans of the Condominium recorded simultaneously with and as part of the Master Deed, and the provisions of Madrid Square Condominium Trust and the By-laws of the Condominium contained therein, recorded with the Master Deed, as the same may be amended from time to time by instruments duly recorded, which provisions together with any amendments thereto, shall constitute covenants running with the land and shall bind any person having at any time any interest or estate in the Unit, his family, servants and visitors, as though such provisions were recited and stipulated at length herein.
The Unit is intended to be used only for residential purposes as provided in Paragraph 6 of the Master Deed and is subject to further restrictions on use as set forth in Paragraphs 6 and 7 of the Master Deed.
The Unit is conveyed subject to such further easements and restrictions of record, if any, as may be in force and applicable.
Meaning and intending to convey and hereby conveying the premises conveyed to us by deed of Carlos A. Goncalves Fontes et ux to be recorded herewith at Plymouth County Registry of Deeds.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated March 9, 2018 and recorded in the Plymouth County Registry of Deeds in Book 49572, Page 270.
Said Unit will be conveyed together with an undivided percentage interest in the Common Elements of said Condominium appurtenant to said Unit and together with all rights, easements, covenants and agreements as contained and referred to in the Declaration of Condominium, as amended.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
