NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 07/16/2004, DENNIS HARRIS AND BRENDA HARRIS executed a Promissory Note payable to the order of GREATER ACCEPTANCE MORTGAGE CORP, AS LENDER.
WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated 07/16/2004, executed by DENNIS HARRIS AND BRENDA HARRIS , MARRIED and being recorded on 08/06/2004 in Book 6093, Page 776 as Document No. 0907441 of the records of the Hinds County, State of Mississippi; and which aforesaid Instrument conveys to FIDELITY NATIONAL TITLE INSURANCE COMPANY OF NEW YORK, A NEW YORK CORPORATION, Trustee and to GREATER ACCEPTANCE MORTGAGE CORP, AS LENDER, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, the hereinafter described property; and
WHEREAS, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., ("MERS"), AS BENEFICIARY, AS NOMINEE FOR GREATER ACCEPTANCE MORTGAGE CORP., assigned said Deed of Trust to The Bank of New York Mellon f/k/a The Bank of New York, a New York banking corporation, as Trustee for CPT Asset-Backed Certificates, Series 2004-EC1 via an instrument filed of record on November 15, 2022 as Document No. 1822137, in Book 7290, and at Page 4593 in the office of the Clerk of the Hinds County, State of Mississippi; and
WHEREAS, THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK, A NEW YORK BANKING CORPORATION, AS TRUSTEE FOR CPT ASSET-BACKED CERTIFICATES, SERIES 2004-EC1 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC., as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 08/22/2024 and recorded on 09/10/2024 in Book 7311, Page 2908 as Document No. 1876606 of the records of the Hinds County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said Promissory Note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc., the Substituted Trustee in said Deed of Trust will on 04/10/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the North Front Door, Hinds County Courthouse (1st Judicial District), 407 East Pascagoula Street, Jackson, MS 39201, the following described property located and situated in Hinds County, Mississippi, to wit:
THE FOLLOWING DESCRIBED LAND AND PROPERTY SITUATED IN THE FIRST JUDICIAL DISTRICT OF HINDS COUNTY, MISSISSIPPI, TO WIT:
LOT 123, OAK CREEK SUBDIVISION, PART II, A SUBDIVISION ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF HINDS COUNTY, AT JACKSON, MISSISSIPPI, IN PLAT BOOK 27 AT PAGE 8, REFERENCE TO WHICH MAP OR PLAT IS HEREBY MADE IN AID OF AND AS A PART OF THIS DESCRIPTION.
BEING THE SAME PROPERTY CONVEYED TO DENNIS HARRIS AND BRENDA HARRIS BY DEED FROM CATHERINE W. GIBSON RECORDED 09/20/1991 IN DEED BOOK 3880 PAGE 138, IN THE OFFICE OF THE CHANCERY CLEARK OF HINDS COUNTY, MISSISSIPPI.
More commonly known as: 211 FOREST DALE DRIVE, JACKSON, MS 39212
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
