NOTICE OF DECISION
NOTICE is hereby given that on the 11th day of February, 2026, the Berkeley Township Board of Adjustment adopted a Resolution of Approval of the application of Rudolph F. Rinderer, with regard to premises known as Block 882, Lot 1.02, commonly known as 18 John F. Kennedy Boulevard, Berkeley Township, New Jersey. The applicant obtained approval of Use Variances and Minor Subdivision Plan to subdivide Lot 1.02, a 0.70 acre lot, into two (2) proposed lots, to be known as Lot 1.05 and Lot 1.06 creating two (2) residential lots for the construction of two-story single family dwellings with basements in the HB zone (highway business zone) whereas single family homes are not a permitted use, together with the following bulk variances: (1) minimum front yard setback, 50 ft. is required; 40.0 ft for both lots is proposed; (2) minimum rear yard setback, 40 ft is required; 27.0 ft. is proposed for Lot 1.05 and 22.9 ft. is proposed for Lot 1.06, together with the following design waivers: (1) from providing curbs along the north side of John F. Kennedy Boulevard; (2) from providing sidewalks along the north side of John F. Kennedy Boulevard; (3) from providing a tree removal plan; and (4) from providing a shade tree and utility easement.
The approval is subject to conditions set forth in the Resolution. A copy of the plans and all related documents are on file with the Berkeley Township Board of Adjustment, 627 Pinewald-Keswick Road, Bayville, New Jersey and may be inspected during normal business hours.
