NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that upon the Application of Modern Day Recycling, Inc. (the "Applicant"), the Zoning Board of Adjustment for the Township of Barnegat (the "Zoning Board") shall conduct a public hearing on Monday, April 13, 2026, commencing at 7:00 p.m., in the Municipal Courtroom of the Barnegat Township Municipal Building, located at 900 West Bay Avenue, Barnegat, New Jersey 08005-1298, to consider an Application for a Request for Clarification of Resolution Nos. Z-2022-12 & Z-2022-12A related to the conversion of a single-family dwelling to a commercial office building, as part of the existing automotive recycling operations, and, if necessary, Use Variance Approval, for property consisting of 8.6 +/- acres of land, located at 866 N.J.S.H. Route 72, within the Township's Preservation Area (PA) Zoning District, and identified on the Official Barnegat Township Tax Maps as Block 24, Lots 4 and 4.01 (formerly known as Block 24, Lots 1-4, 4.01, and 5-8; Block 25, Lots 1-14; Block 26, Lots 1-20; and Block 27, Lots 1-14) (the "Property").
Previously, the Zoning Board granted Use Variance Approval and Minor Site Plan Approval on May 9, 2022, and thereafter, on June 13, 2022, adopted Resolution No. Z-2022-12 memorializing those Approvals to allow for the development and use of (i) a 600 +/- square-foot metal carport and (ii) a 750 +/- square-foot metal carport as part of the existing, automotive recycling center operations on the Property.
Following that, the Zoning Board on September 12, 2022, determined that the metal carports did not constitute a greater than fifty (50%) percent expansion of the pre-existing automobile recycling center use and, thereafter, adopted Resolution No. Z-2022-12A memorializing that determination.
By correspondence dated November 14, 2025 and February 18, 2026, the Pinelands Commission (the "Commission") advised the Applicant that Resolution Nos. Z-2022-12 and Z-2022-12A do not expressly address whether the change of use of a pre-existing single-family dwelling to a commercial office does not constitute a greater than 50 percent expansion of the pre-existing automotive recycling center use.
For that reason, the Applicant is specifically requesting that the Zoning Board provide its clarification, determination, and resolution confirming that the change of use of the pre-existing single-family dwelling to a commercial office does not constitute a greater than 50 percent expansion of the pre-existing automotive recycling center use on the Property as it existed on January 14, 1981 and, to the extent necessary, grant Use Variance Approval to allow for the prior conversion of the single-family dwelling into commercial office space.
During the course of the review of the Application and/or presentation of the Application, it is possible that bulk variances, submission waivers, design waivers, interpretations, and/or other exceptions from the requirements of the Township's Land Use Ordinance may be identified or deemed to be necessary to permit approval of the Application as submitted or with such changes as may be requested or accepted by the Zoning Board. This notice is to advise you that such additional bulk variances, submission waivers, design waivers, interpretations, and/or other exceptions may be requested by the Applicant at the time of the Zoning Board hearing for this Application.
During the Zoning Board hearing on the Application, the Applicant will request that the Zoning Board grant any and all approvals, submission waivers, design waivers, bulk variances, interpretations, and any and all relief necessary to allow for the use of the Property as proposed by the Applicant.
Anyone interested in this Application will have the opportunity to appear in person at the Zoning Board hearing to be held on Monday, April 13, 2026, commencing at 7:00 p.m. in the Municipal Courtroom of the Barnegat Township Municipal Building, located at 900 West Bay Avenue, Barnegat, NJ 08005-1298, to present any support or objection they may have for the approval of this Application.
ACTION WILL BE TAKEN AT THIS MEETING. THIS MEETING WILL BE HELD IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT pursuant to N.J.S.A. 10:4-8(b).
The Zoning Board may, at its discretion, adjourn, postpone, or continue the hearing from time to time, and you are hereby notified that you should make diligent inquiry of the Zoning Board Secretary concerning such adjournments, postponements, or continuations.
Copies of the Application, plans, reports, correspondence, and supporting documentation are on file in the Planning and Zoning Board Office located at One Ocean Avenue, Barnegat, New Jersey 08005-1298, and are available for public inspection and public review during the Planning and Zoning Office regular business hours (Monday through Friday, 7:30 a.m. through 3:30 p.m. – excluding holidays).
