ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that on Thursday, April 9, 2026 at 7:30 P.M., in the City of Elizabeth City Council Chambers, third floor of City Hall, 50 Winfield Scott Plaza, Elizabeth, New Jersey, the Zoning Board ("Zoning Board") will hold a public hearing on the application of Westminster HY, LLC (the "Applicant"), seeking Amended Preliminary and Final Site Plan approval and bulk ("c") variances in connection with the property located at 420-424 Westminster Avenue, Elizabeth, New Jersey, further identified (incorrectly) as Block 151, Lot 1.02 on the Tax Maps of the City of Elizabeth, and Block 151, Lot 1.01 according to the Elizabeth Tax Collector's Office (the "Property"). The Property is in the City's R-3 (Residential Multifamily) Zone District ("R-3" Zone") and is currently a vacant, unimproved parking lot. The Applicant received Preliminary and Final Site Plan approval on April 11, 2023, which was Memorialized by resolution dated May 9, 2023.
The Applicant now proposes to construct a four-story multi-family residential apartment building with twenty-one (21) units (twenty 1-bedroom apartments and one 3-bedroom apartment).
The following variances were previously approved and confirmed in the Resolution adopted May 9, 2023:
(d)(6) Height Variance: 3 stories/38 ft. permitted; 4 stories/44.25 ft. Approved
Minimum Lot Width: 175 ft. Required; 93 ft. Approved
Minimum Lot Frontage: 175 ft. Required; 93 ft. Approved
Minimum Lot Depth: 260.7 ft. Required; 168.39 ft. Approved
Minimum Front Yard Setback: 47.95 ft. Required; 20 ft. Approved
Minimum Side Yard Setback: 19.25 ft. Required; 5 ft. Approved
Minimum Rear Yard Setback: 58.9 ft. Required; 3 ft. Approved
Maximum Impervious Coverage: 60% Allowed; 78.9% Approved
Maximum Permitted Number of Stories: 3 Stories Allowed; 4 Stories Approved
The Applicant is now requesting additional relief for the following Bulk (c) variances:
Open Space: 4,000 sq. ft. Required; 3,251 sq. ft. Proposed
Maximum Impervious Coverage: 60% Allowed; 83% Proposed
Applicant further seeks any additional deviations, variances, waivers, exceptions, interpretations, de minimis exceptions to RSIS, modifications of conditions of prior approvals, continuation of any preexisting nonconforming conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and/or relief that may be determined to be necessary during the review and processing of the application and/or based upon an analysis of the plans and testimony at the PUBLIC HEARING on the Application. The Applicant reserves the right to supplement its submission either prior to or at the PUBLIC HEARING on this matter.
Beginning ten (10) days prior to the public hearing, Application documents will be available for public inspection on the City of Elizabeth's website at www.elizabethnj.org or may be inspected at the Office of the Bureau of Construction and Zoning, Division of Zoning and Land Use, 50 Winfield Scott Plaza, Elizabeth, New Jersey, during that Office's normal business hours.
