NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 1830 Bay Street, Fall River, MA 02724
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Christina Botelho and Maurice Bouchard to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Ditech Financial LLC, and now held by U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for VRMTG Asset Trust, said mortgage dated October 31, 2017 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 9373, Page 19, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Ditech Financial LLC to LoanCare LLC by assignment dated June 11, 2020 and recorded with said Registry of Deeds in Book 10201, Page 202; said mortgage was assigned from LoanCare LLC to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment dated September 25, 2023 and recorded with said Registry of Deeds in Book 11383, Page 64; said mortgage was assigned from NewRez LLC d/b/a Shellpoint Mortgage Servicing to U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for VRMTG Asset Trust by assignment dated June 7, 2024 and recorded with said Registry of Deeds in Book 11535, Page 272; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 23, 2026 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land in Fall River, Bristol County, Massachusetts, with all buildings and improvements thereon, situated on the easterly side of Bay Street, bounded and described as follows:
WESTERLY by Bay Street, forty-six and 77/1010 (46.77) feet;
NORTHERLY by land believed to be of one Aguiar, one hundred forty-eight and 50/100 (148.50) feet;
EASTERLY by land of parties unknown, forty-five (45) feet; and
SOUTHERLY by land now or formerly of John M. Mendonca, et ux, one hundred sixty-one and 24/100 (161.24) feet.
Containing 25.59 square rods of land, more or less.
The southwesterly corner of said lot being 168.17 feet northerly from the northeasterly corner of Bay Street and contemplated Touhey Street, as measured in the easterly line of said Bay Street, and the northwesterly corner thereof being 341.35 feet southerly from the southeasterly corner of Mount Hope Avenue and Bay Street, as measured in the easterly line of said Bay Street.
Being the same premises conveyed to the Mortgagor(s) herein by deed recorded with said Registry herewith.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated October 31, 2017 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 9373, Page 16.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
