MORTGAGEE'S SALE
34 ROBINHOOD ROAD, WINCHESTER, MASSACHUSETTS
By virtue and in execution of the Power of Sale contained in a certain mortgage and line of credit given by Bonnie L. Hardy and Richard J. King (the “Mortgagor") to Business Development Company of Rhode Island dated October 10, 2018, and recorded on October 10, 2018 with the Middlesex South District Registry of Deeds in Book 71729 at Page 481 and Book 71729 at Page 492, and a certain Term Loan dated May 24, 2019 secured by said Mortgage, of which mortgage the undersigned, Business Development Company of Rhode Island, a banking association (the "Mortgagee"), is the present holder, for breach of the conditions of said Mortgage and for the purpose of foreclosing on the mortgaged premises described below, said premises will be sold at Public Auction on said premises at 1:00 p.m. on the 16th day of April, 2026, to wit:
Property Address: 34 Robinhood Road, Winchester, Massachusetts
A certain parcel of land together with the buildings and Improvements thereon, situated In Winchester, Middlesex County, Massachusetts, and being shown as Lot 242A on "Plan of Land In Winchester" dated March 8, 1960, Kon-Tak Engineering Service, Surveyor, duly recorded with Middlesex South District Deeds Book 9724, Page 197 and being a revision of "Plan of redivision of Lots, Vernon Hill, Winchester, Massachusetts," dated November 5, 1940, and recorded with said Deeds Book 6457, Page 566; and bounded and described as follows:
NORTHEASTERLY by Robinhood Road, eighty-three and 62/100 (83.62) feet;
EASTERLY by Lot 241, as shown on plan recorded with said Deeds Book 6457, Page 566, one hundred fourteen and 86/100 (114.86) feet;
SOUTHERLY by Lot 248, as shown on plan recorded with said Deeds Book 6457, Page 566, forty and 99/100 (40.99) feet;
SOUTHWESTERLY by Lot 245, as shown on plan recorded with said Deeds Book 6457, page 566, forty-four and 50/100 (44.50) feet; and
WESTERLY by Lot 243A as shown on plan recorded with said Deeds Book 9724, Page 197,
one hundred twenty-seven and 47/100 (127.47) feet.
Containing according to said plan, 10,396 square feet of land, more or less.
Together with the right in common with others entitled thereto, to pass and repass over all the streets and ways shown on said plans for all the purposes for which such ways are commonly used in said Winchester.
The Mortgagee reserves the right to postpone all or part of the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date.
Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any.
In the event that the successful bidder(s) at the foreclosure sale shall default in purchasing the within described properties according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the next highest bidders provided that the next highest bidder shall deposit with Mortgagee's attorneys, Simmons Associates, Ltd., the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and upon payment in full of the next highest bid title shall be conveyed to said next highest bidder within thirty (30) days of said written notice.
TERMS OF SALE: A Ten Thousand Dollar ($10,000) non-refundable deposit will be required to be paid in cash or by certified check at the time and place of sale as earnest money for the above-named parcel. The balance is to be paid in cash or by certified check within thirty (30) days of the date of the sale and shall be deposited in escrow with the firm of Simmons Associates, Ltd., 4 Richmond Square, Suite 102, Providence, Rhode Island 02906.
