NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by 718 E. 35th St, LLC to MoFin Lending Corporation dated April 21, 2023, and recorded in Deed Book 3074, Page 426, Chatham County Records, said Security Deed having been last sold, assigned, transferred and conveyed to U.S. BANK TRUST NATIONAL ASSOCIATION NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF 2 ACQUISITION TRUST, securing a Note in the original principal amount of $1,190,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, May 5, 2026, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
The Land is described as follows:
ALL THOSE CERTAIN LOTS TRACTS, OR PARCELS OF LAND SITUATE, LYING AND BEING IN THE CITY OF SAVANNAH, CHATHAM COUNTY, GEORGIA, AND BEING KNOWN AND DESIGNATED AS LOTS TWENTY-SIX (26), TWENTY-SEVEN(27), AND TWENTY-EIGHT (28), BLOCK OR SECTION D, UPON THE MAP OR PLAT OF THE SUBDIVISION OF THE SOUTHERN PORTIONS OF MILLEN FARM LOTS NUMBER 6 AND 7, SCHWARZ WARD, MADE BY PERCY SUGDEN, C.E., DATED FEBRUARY 3, 1915, AND RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA IN MAP BOOK 1, PAGE 21, WHICH IS INCORPORATED HEREIN AND MADE A PART HEREOF BY THIS REFERENCE. SAID LOTS LYING CONTIGUOUS, HAVING A COMBINED SOUTHERN FRONTAGE OF 90 FEET ON 35TH STREET BETWEEN ATLANTIC AND PAULSEN STREETS WITH A UNIFORM DEPTH OF 92.10 FEET NORTHWARDLY TO A LANE; AND AS ONE BODY OF LAND, BEING BOUNDED AS FOLLOWS; ON THE NORTH BY SAID LANE; ON THE EAST BY LOT 25 , SAID SUBDIVISION AND WARD; ON THE SOUTH BY 35TH STREET, AND ON THE WEST BY LOT 29, SAID SUBDIVISION AND WARD.
Said property is known as 718 East 35th Street, Savannah, GA 31401, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
