NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 05/14/2004, MARY ROBINSON executed a Promissory Note payable to the order of AMERIQUEST MORTGAGE COMPANY.
WHEREAS, the aforesaid Promissory Note was secured by a Deed of Trust dated 05/14/2004, executed by MARY ROBINSON and being recorded on 07/21/2004 in Book 1809, Page 617 as Document No. 445489 of the records of the Madison County, State of Mississippi; and which aforesaid Instrument conveys to JIM B. TOHILL, Trustee and to AMERIQUEST MORTGAGE COMPANY, as Beneficiary, the hereinafter described property; and
WHEREAS, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE OF AMERIQUEST MORTGAGE SECURITIES INC., ASSET BACKED PASS-THROUGH CERTIFICATES, SERIES 2004-R5 UNDER THE POOLING & SERVICING AGREEMENT DATED AS OF JUNE 1, 2004 WITHOUT RECOURSE assigned said Deed of Trust to DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR AMERIQUEST MORTGAGE SECURITIES INC., ASSET-BACKED PASS-THROUGH CERTIFICATES, SERIES 2004-R5 via an instrument filed of record on March 18, 2011 as Document No. 643126, in Book 2650 , and at Page 444 in the office of the Clerk of the Madison, State of Mississippi; and
WHEREAS, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR AMERIQUEST MORTGAGE SECURITIES INC., ASSET-BACKED PASS-THROUGH CERTIFICATES, SERIES 2004-R5 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 03/05/2026 and recorded on 03/09/2026 in Book T-4654, Page 909 as Document No. 1047104 of the records of the Madison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said Promissory Note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc., the Substituted Trustee in said Deed of Trust will on 04/16/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the South Door, Madison County Courthouse, 128 West North Street, Canton, MS 39046, the following described property located and situated in Madison County, Mississippi, to wit:
LOT 15, ANNANDALE ESTATES, PART ONE, A SUBDIVISION ACCORDING TO A MAP OR PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF MADISON COUNTY AT CANTON, MISSISSIPPI IN PLAT CABINET C AT SLOT 119 THEREOF, REFERENCE TO WHICH MAP OR PLAT IS HEREBY MADE IN AID OF AND AS A PART OF THIS DESCRIPTION.
BEING THE PROPERTY CONVEYED IN WARRANTY DEED FROM BARRY D. WOODWARD AND WIFE, ELIZABETH C. WOODWARD TO LOUIE A. ROBINSON, DATED 11/11/1997, RECORDED 11/14/1997, IN DEED BOOK 407, PAGE 647, IN THE CLERK OF CHANCERY COURT FOR MADISON COUNTY, MISSISSIPPI.
More commonly known as: 191 FORREST LAKE DR, MADISON, MS 39110
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
Please be advised that the trustee may require entity or trust bidders at this trustee’s sale to provide information, documentation and/or certification of the vesting instructions and the data required to be reported pursuant to FinCEN regulations effective for transfers of residential real property to covered transferees on or after March 1, 2026.
